1. Tìm hiểu về dạy thêm, học thêm
1.1. Hiểu thế nào là dạy thêm, học thêm?
Điều 2 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Dạy thêm, học thêm là hoạt động giảng dạy bổ sung ngoài thời lượng đã được quy định trong kế hoạch giáo dục đối với các môn học và hoạt động giáo dục (gọi chung là môn học) thuộc Chương trình giáo dục phổ thông, Chương trình giáo dục thường xuyên cấp trung học cơ sở, và Chương trình giáo dục thường xuyên cấp trung học phổ thông do Bộ trưởng Bộ Giáo dục và Đào tạo ban hành.
Dạy thêm, học thêm trong nhà trường là hoạt động dạy thêm, học thêm do các cơ sở giáo dục phổ thông, cơ sở giáo dục thường xuyên hoặc các cơ sở giáo dục khác thực hiện theo Chương trình giáo dục phổ thông và Chương trình giáo dục thường xuyên cấp trung học cơ sở, trung học phổ thông (gọi chung là nhà trường) tổ chức.
Dạy thêm, học thêm ngoài nhà trường là hoạt động dạy thêm, học thêm không do các cơ sở được nêu tại khoản 2 Điều này tổ chức thực hiện.
Lưu ý: Giáo dục phổ thông bao gồm 3 cấp học: giáo dục tiểu học, giáo dục trung học cơ sở và giáo dục trung học phổ thông.
Giáo dục tiểu học kéo dài 05 năm, từ lớp một đến lớp năm. Học sinh vào lớp một ở độ tuổi 06, tính theo năm;
Giáo dục trung học cơ sở kéo dài 04 năm, từ lớp sáu đến lớp chín. Học sinh vào lớp sáu phải hoàn thành chương trình tiểu học, với độ tuổi vào lớp sáu là 11, tính theo năm;
Giáo dục trung học phổ thông kéo dài 03 năm, từ lớp mười đến lớp mười hai. Học sinh vào lớp mười phải có bằng tốt nghiệp trung học cơ sở, với độ tuổi vào lớp mười là 15, tính theo năm.
Understanding Extra Teaching and Learning
What does extra teaching and learning mean?
Article 2 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Extra teaching and learning refer to supplementary teaching activities outside the time allocated in the educational plan for subjects and educational activities (collectively referred to as subjects) within the General Education Program, the Continuing Education Program at the lower secondary level, and the Continuing Education Program at the upper secondary level, as issued by the Minister of Education and Training.
Extra teaching and learning within schools are activities organized by educational institutions such as general education schools, continuing education institutions, or other educational facilities, according to the General Education Program and Continuing Education Programs at the lower and upper secondary levels (collectively referred to as schools).
Extra teaching and learning outside schools are activities not organized by the institutions mentioned in Clause 2 of this Article.
Note: General education consists of three levels: primary education, lower secondary education, and upper secondary education.
Primary education lasts for 5 years, from grade 1 to grade 5. Students enter grade 1 at the age of 6, calculated by year.
Lower secondary education lasts for 4 years, from grade 6 to grade 9. Students must have completed primary education to enter grade 6, and the age of entry to grade 6 is 11, calculated by year.
Upper secondary education lasts for 3 years, from grade 10 to grade 12. Students must have a lower secondary graduation certificate to enter grade 10, and the age of entry to grade 10 is 15, calculated by year.
1.2. Nguyên tắc dạy thêm, học thêm?
Điều 3 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Dạy thêm, học thêm chỉ được tổ chức khi học sinh có nhu cầu và tự nguyện tham gia, đồng thời phải được sự đồng ý của cha mẹ hoặc người giám hộ (gọi chung là cha mẹ học sinh). Các nhà trường, tổ chức hoặc cá nhân không được phép ép buộc học sinh tham gia học thêm dưới bất kỳ hình thức nào.
Nội dung dạy thêm, học thêm phải tuân thủ quy định của pháp luật Việt Nam, không chứa định kiến về sắc tộc, tôn giáo, nghề nghiệp, giới tính, hoặc địa vị xã hội. Việc dạy thêm không được cắt giảm nội dung dạy học đã có trong kế hoạch giáo dục của nhà trường để đưa vào các buổi học thêm.
Việc dạy thêm, học thêm cần hướng tới mục tiêu phát triển phẩm chất và năng lực của học sinh, không được làm ảnh hưởng đến việc thực hiện chương trình giáo dục chung của nhà trường hoặc chương trình môn học mà giáo viên đang giảng dạy.
Thời lượng, thời gian, địa điểm và hình thức tổ chức dạy thêm, học thêm phải phù hợp với đặc điểm tâm sinh lý lứa tuổi, đảm bảo sức khỏe cho học sinh và tuân thủ các quy định pháp luật về thời gian làm việc, làm thêm giờ. Đồng thời, phải đảm bảo an ninh, trật tự, an toàn, vệ sinh môi trường, và phòng chống cháy nổ tại nơi tổ chức các lớp học thêm.
Principles of Extra Teaching and Learning
Article 3 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Extra teaching and learning can only be organized when students voluntarily choose to participate and must have the consent of their parents or guardians (collectively referred to as the students’ parents). Schools, organizations, or individuals are not allowed to force students to participate in extra learning under any circumstances.
The content of extra teaching and learning must comply with the laws of Vietnam and should not contain any biases related to race, religion, profession, gender, or social status. Extra teaching should not reduce or alter the content already included in the school’s educational plan for regular classes.
Extra teaching and learning should aim to develop students’ qualities and abilities without interfering with the implementation of the school’s general educational program or the subject programs taught by teachers.
The duration, time, location, and methods of organizing extra teaching and learning must be suitable for the students’ psychological and physical development, ensuring their health and complying with legal regulations regarding working hours and overtime. At the same time, the safety, order, environmental hygiene, and fire prevention regulations at the location of the extra classes must be guaranteed.
1.3. Không được tổ chức dạy thêm, học thêm khi nào?
Điều 4 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Không được tổ chức dạy thêm cho học sinh tiểu học, ngoại trừ các trường hợp bồi dưỡng về nghệ thuật, thể dục thể thao hoặc rèn luyện kỹ năng sống.
Giáo viên đang giảng dạy tại các nhà trường không được phép dạy thêm ngoài nhà trường và thu tiền của học sinh mà họ đang trực tiếp giảng dạy theo kế hoạch giáo dục của nhà trường.
Giáo viên thuộc các trường công lập không được tham gia quản lý hoặc điều hành hoạt động dạy thêm ngoài nhà trường, nhưng vẫn được phép tham gia giảng dạy thêm ngoài nhà trường.
When is extra teaching and learning not allowed to be organized?
Article 4 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Extra teaching for elementary school students is not allowed, except for cases of supplementary education in arts, sports, or life skills training.
Teachers currently teaching at schools are not permitted to conduct extra teaching outside the school and charge fees for students they are directly teaching according to the school’s educational plan.
Teachers in public schools are not allowed to participate in managing or organizing extra teaching outside the school, but they are still allowed to teach extra lessons outside the school.
2. Quy định mới về dạy thêm, học thêm 2025
2.1. Dạy thêm trong nhà trường
Điều 5 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Dạy thêm, học thêm trong nhà trường không được thu tiền từ học sinh và chỉ áp dụng cho các đối tượng học sinh đăng ký học thêm theo từng môn học, bao gồm:
+ Học sinh có kết quả học tập môn học ở cuối học kỳ liền kề đạt mức chưa đạt;
+ Học sinh được nhà trường chọn để bồi dưỡng học sinh giỏi;
+ Học sinh lớp cuối cấp tự nguyện đăng ký ôn thi tuyển sinh hoặc ôn thi tốt nghiệp theo kế hoạch giáo dục của nhà trường.
+ Nhà trường tổ chức cho các học sinh thuộc đối tượng nêu tại khoản 1 viết đơn đăng ký học thêm theo từng môn học và khối lớp (theo Mẫu số 01 tại Phụ lục kèm theo Thông tư này).
+ Dựa trên số lượng học sinh đăng ký, nhà trường lập kế hoạch tổ chức dạy thêm cho từng môn học và từng khối lớp.
Việc xếp lớp, xếp thời khóa biểu và tổ chức dạy thêm, học thêm phải đáp ứng các yêu cầu sau:
+ Lớp dạy thêm được sắp xếp theo từng môn học và khối lớp, mỗi lớp không quá 45 học sinh;
+ Không bố trí giờ dạy thêm xen kẽ với thời khóa biểu chính và không dạy trước các nội dung của chương trình môn học trong kế hoạch giáo dục của nhà trường;
+ Mỗi môn học chỉ được tổ chức dạy thêm tối đa 2 tiết/tuần.
+ Kế hoạch tổ chức dạy thêm, học thêm phải được công khai trên trang thông tin điện tử của nhà trường hoặc niêm yết tại trường.
New regulations on extra teaching and learning
Extra teaching in schools
Article 5 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Extra teaching and learning in schools must not charge students and only apply to students who voluntarily register for extra lessons for each subject, including:
Students who have not achieved the required level in their subject at the end of the previous semester;
Students selected by the school for gifted student training;
Final-year students who voluntarily register for entrance exam preparation or graduation exam revision according to the school’s educational plan.
The school organizes for students in the above categories to write a registration form for extra lessons in each subject and grade level (according to Form No. 01 in the Annex of this Circular).
Based on the number of students registering, the school will develop a plan for organizing extra teaching for each subject and grade level.
The class assignment, timetable arrangement, and organization of extra teaching must meet the following requirements:
Extra classes must be arranged by subject and grade level, with no more than 45 students per class;
Extra lessons must not be scheduled during the main timetable and cannot cover content before the subject’s curriculum as per the school’s educational plan;
Each subject can only have a maximum of 2 extra lessons per week.
The plan for organizing extra teaching and learning must be publicly posted on the school’s website or displayed at the school.
2.2. Dạy thêm ngoài nhà trường
Điều 6 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Tổ chức hoặc cá nhân tổ chức hoạt động dạy thêm, học thêm ngoài nhà trường có thu tiền của học sinh (gọi chung là cơ sở dạy thêm) phải đáp ứng các yêu cầu:
Đăng ký kinh doanh theo quy định của pháp luật;
Công khai thông tin trên cổng thông tin điện tử hoặc niêm yết tại trụ sở của cơ sở dạy thêm, bao gồm: các môn học được tổ chức dạy thêm; thời lượng dạy thêm theo từng môn học và từng khối lớp; địa điểm, hình thức, thời gian tổ chức dạy thêm, học thêm; danh sách người dạy thêm; mức thu tiền học thêm. Tất cả các thông tin này phải được công bố trước khi tuyển sinh các lớp dạy thêm, học thêm (theo Mẫu số 02 tại Phụ lục kèm theo Thông tư này).
Người dạy thêm ngoài nhà trường phải đảm bảo có phẩm chất đạo đức tốt và năng lực chuyên môn phù hợp với môn học tham gia dạy thêm.
Giáo viên đang giảng dạy tại các nhà trường nếu tham gia dạy thêm ngoài nhà trường phải báo cáo với Hiệu trưởng, Giám đốc hoặc người đứng đầu nhà trường (gọi chung là Hiệu trưởng). Báo cáo cần nêu rõ môn học, địa điểm, hình thức và thời gian tham gia dạy thêm (theo Mẫu số 03 tại Phụ lục kèm theo Thông tư này).
Extra teaching outside of schools
Article 6 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Organizations or individuals conducting extra teaching and learning activities outside of schools that charge students (collectively referred to as extra teaching establishments) must meet the following requirements:
Register for business according to the law;
Publicly disclose information on the electronic portal or display it at the establishment’s premises, including: the subjects offered for extra lessons, the duration of extra lessons for each subject and grade level, the location, format, and time of extra teaching and learning sessions, the list of instructors, and the fees for extra lessons. All this information must be published before enrolling students for extra lessons (according to Form No. 02 in the Annex of this Circular).
Instructors for extra teaching outside schools must ensure they have good moral character and appropriate professional competence for the subject they are teaching.
Teachers currently working at schools who wish to participate in extra teaching outside of school must report to the principal, director, or head of the school (collectively referred to as the principal). The report should specify the subject, location, format, and time of the extra teaching (according to Form No. 03 in the Annex of this Circular).
3. Thu và quản lý tiền học thêm
Điều 7 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Kinh phí tổ chức dạy thêm, học thêm trong nhà trường được sử dụng từ nguồn ngân sách nhà nước và các nguồn kinh phí hợp pháp khác theo quy định của pháp luật.
Mức thu tiền học thêm ngoài nhà trường được xác định dựa trên sự thỏa thuận giữa cha mẹ học sinh, học sinh và cơ sở dạy thêm.
Việc thu, quản lý và sử dụng tiền học thêm phải tuân thủ các quy định của pháp luật về tài chính, ngân sách, tài sản, kế toán, thuế và các quy định khác có liên quan.
Collection and management of extra tuition fees
Article 7 of Circular No. 29/2024/TT-BGDDT stipulates the following:
The funding for organizing extra teaching and learning activities within schools is sourced from the state budget and other legally authorized funding sources as per the law.
The fees for extra teaching outside of schools are determined based on an agreement between the students’ parents, the students, and the extra teaching establishment.
The collection, management, and use of extra tuition fees must comply with legal regulations on finance, budgeting, assets, accounting, taxes, and other related regulations.
4. Trách nhiệm của các cơ quan
4.1. Uỷ ban nhân dân cấp tỉnh
Điều 8 Thông tư số 29/2024/TT-BGDDT quy định như sau:
+ Chịu trách nhiệm quản lý hoạt động dạy thêm, học thêm tại địa phương.
+ Ban hành quy định về dạy thêm, học thêm của địa phương, bao gồm các nội dung chính:
+ Trách nhiệm của Ủy ban nhân dân các cấp, các cơ quan quản lý giáo dục và các cơ quan liên quan trong việc thực hiện quy định về dạy thêm, học thêm;
+ Việc quản lý và sử dụng kinh phí tổ chức dạy thêm, học thêm;
+ Công tác thanh tra, kiểm tra và xử lý vi phạm.
+ Chỉ đạo việc thanh tra, kiểm tra các hoạt động dạy thêm, học thêm trên địa bàn quản lý và xử lý vi phạm theo quy định của pháp luật.
Responsibilities of authorities
Provincial People’s Committee
Article 8 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Responsible for managing extra teaching and learning activities in the local area.
Issue regulations on extra teaching and learning at the local level, including the following main contents:
The responsibilities of local People’s Committees, educational management agencies, and related agencies in implementing the regulations on extra teaching and learning;
The management and use of funding for organizing extra teaching and learning;
Inspection, supervision, and handling of violations.
Direct the inspection and supervision of extra teaching and learning activities in the managed area and handle violations in accordance with the law.
4.2. Sở giáo dục đào tạo
Điều 9 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Chủ trì và phối hợp với các cơ quan liên quan tham mưu cho Ủy ban nhân dân cấp tỉnh ban hành quy định về dạy thêm, học thêm tại địa phương.
Hướng dẫn và tổ chức thực hiện các quy định về dạy thêm, học thêm đối với các nhà trường, tổ chức và cá nhân liên quan thuộc phạm vi quản lý trên địa bàn.
Tổ chức hoặc phối hợp với các cơ quan liên quan tiến hành thanh tra, kiểm tra hoạt động dạy thêm, học thêm trên địa bàn quản lý; xử lý vi phạm theo thẩm quyền hoặc đề nghị cơ quan có thẩm quyền xử lý.
Department of Education and Training
Article 9 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Lead and coordinate with relevant agencies to advise the Provincial People’s Committee on issuing regulations regarding extra teaching and learning at the local level.
Organize or cooperate with relevant agencies to inspect and supervise extra teaching and learning activities in the managed area; handle violations within its authority or request relevant authorities to handle them.
4.3. Uỷ ban nhân dân cấp huyện
Điều 10 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Chịu trách nhiệm quản lý hoạt động dạy thêm, học thêm trên địa bàn.
Hướng dẫn và kiểm tra việc thực hiện các quy định về dạy thêm, học thêm tại địa phương; xử lý vi phạm hoặc kiến nghị cơ quan có thẩm quyền xử lý.
Chỉ đạo Ủy ban nhân dân cấp xã thực hiện việc giám sát và kiểm tra việc tuân thủ các quy định pháp luật về thời giờ làm việc, giờ làm thêm, an ninh, trật tự, an toàn, vệ sinh môi trường, và phòng chống cháy nổ của các tổ chức, cá nhân tổ chức dạy thêm, học thêm ngoài nhà trường trên địa bàn.
District People’s Committee
Article 10 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Be responsible for managing extra teaching and learning activities in the area.
Guide and inspect the implementation of regulations on extra teaching and learning at the local level; handle violations or recommend relevant authorities to handle them.
Direct the Commune People’s Committee to supervise and inspect the compliance with legal regulations on working hours, overtime, security, order, safety, environmental sanitation, and fire prevention of organizations and individuals conducting extra teaching and learning outside schools in the area.
4.4. Phòng Giáo dục đào tạo
Điều 11 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Chủ trì và phối hợp với các cơ quan liên quan thực hiện việc quản lý dạy thêm, học thêm trên địa bàn.
Hướng dẫn và tổ chức thực hiện các quy định về dạy thêm, học thêm cho các nhà trường, tổ chức và cá nhân liên quan trong phạm vi quản lý.
Tổ chức hoặc phối hợp với các cơ quan liên quan tiến hành kiểm tra hoạt động dạy thêm, học thêm trên địa bàn quản lý; xử lý vi phạm theo thẩm quyền hoặc đề nghị cơ quan có thẩm quyền xử lý.
Department of Education and Training
Article 11 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Take the lead and cooperate with relevant agencies to manage extra teaching and learning activities in the area.
Provide guidance and organize the implementation of regulations on extra teaching and learning for schools, organizations, and individuals within the scope of management.
Organize or cooperate with relevant agencies to inspect extra teaching and learning activities in the managed area; handle violations within their authority or recommend relevant authorities to handle them.
4.5. Uỷ ban nhân dân cấp xã
Điều 12 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Phối hợp với Phòng Giáo dục và Đào tạo cùng các cơ quan liên quan quản lý việc thực hiện quy định về dạy thêm, học thêm trên địa bàn.
Thực hiện chỉ đạo của Ủy ban nhân dân cấp huyện theo quy định tại khoản 3 Điều 10 Thông tư này.

4.6. Trách nhiệm của Hiệu trưởng
Điều 13 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Tổ chức việc dạy thêm, học thêm trong nhà trường theo quy định tại Thông tư này và các quy định pháp luật có liên quan.
Quản lý giáo viên đang dạy học tại nhà trường khi tham gia dạy thêm ngoài nhà trường, đảm bảo thực hiện đúng quy định tại khoản 3 Điều 6 Thông tư này; phối hợp theo dõi và kiểm tra hoạt động dạy thêm ngoài nhà trường của giáo viên.
Chịu trách nhiệm trước cơ quan quản lý trực tiếp về chất lượng dạy thêm, học thêm trong nhà trường; về việc quản lý và sử dụng kinh phí tổ chức dạy thêm, học thêm trong nhà trường theo quy định.
Xử lý vi phạm theo thẩm quyền hoặc kiến nghị cơ quan có thẩm quyền xử lý vi phạm liên quan đến dạy thêm, học thêm.
Tiếp nhận và xử lý ý kiến, kiến nghị, nguyện vọng của học sinh và cha mẹ học sinh về việc dạy thêm, học thêm trước và trong quá trình tổ chức thực hiện.
Responsibilities of the Principal
Article 13 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Organize extra teaching and learning activities in the school according to the regulations in this Circular and other relevant laws.
Manage teachers who are teaching at the school when participating in extra teaching outside the school, ensuring compliance with the provisions of Clause 3, Article 6 of this Circular; coordinate to monitor and inspect the extra teaching activities outside the school of these teachers.
Be responsible to the direct management authority for the quality of extra teaching and learning within the school; for managing and using funds for extra teaching and learning in the school as per regulations.
Handle violations within their authority or propose to the competent authorities to handle violations related to extra teaching and learning.
Receive and address the opinions, recommendations, and requests of students and their parents regarding extra teaching and learning before and during the implementation process.
4.7. Cơ sở dạy thêm
Điều 14 Thông tư số 29/2024/TT-BGDDT quy định như sau:
Thực hiện các quy định về dạy thêm, học thêm tại Thông tư này và các quy định pháp luật có liên quan.
Quản lý và bảo đảm chất lượng dạy thêm, học thêm cùng quyền lợi của học sinh học thêm và người dạy thêm; quản lý và sử dụng tiền học thêm theo quy định.
Quản lý và lưu giữ hồ sơ tổ chức dạy thêm, học thêm theo quy định.
Báo cáo và giải trình về việc thực hiện các quy định tại Thông tư này và các quy định pháp luật có liên quan với các cơ quan chức năng khi được yêu cầu.
Tiếp nhận và xử lý ý kiến, kiến nghị, nguyện vọng của học sinh và cha mẹ học sinh về việc dạy thêm, học thêm trước và trong quá trình tổ chức thực hiện.
Extra teaching institutions
Article 14 of Circular No. 29/2024/TT-BGDDT stipulates the following:
Implement the regulations on extra teaching and learning in this Circular and other relevant laws.
Manage and ensure the quality of extra teaching and learning, along with the rights of students and teachers involved in extra teaching; manage and use extra teaching fees in accordance with regulations.
Manage and retain records of extra teaching and learning activities as required by regulations.
Report and explain the implementation of the provisions in this Circular and other relevant laws to the competent authorities when requested.
Receive and address the opinions, recommendations, and requests of students and their parents regarding extra teaching and learning before and during the implementation process.
