1. Cases of land reclamation for national defense and security purposes?

Các trường hợp thu hồi đất vì mục đích quốc phòng, an ninh?

Nhà nước thu hồi đất vì mục đích quốc phòng, an ninh trong các trường hợp sau đây theo quy định tại Điều 78 của Luật Đất đai 2024:

The State reclaims land for national defense and security purposes in the following cases as stipulated in Article 78 of the Land Law 2024:

+ Sử dụng làm nơi đóng quân, trụ sở làm việc;

Used as military bases or office headquarters.

+ Sử dụng làm căn cứ quân sự;

Used as a military base.

+ Sử dụng làm công trình phòng thủ quốc gia, trận địa và các công trình đặc biệt về quốc phòng, an ninh;

Used for national defense facilities, military positions, and special defense and security structures.

+ Sử dụng làm ga, cảng, công trình thông tin quân sự, an ninh;

Used as military and security stations, ports, and communication facilities.

+ Sử dụng làm kho tàng của lực lượng vũ trang nhân dân;

Used as storage facilities for the people’s armed forces.

+ Sử dụng làm trường bắn, thao trường, bãi thử vũ khí, bãi hủy vũ khí;

Used as shooting ranges, training grounds, weapon testing areas, and weapon disposal sites.

+ Sử dụng làm cơ sở đào tạo, trung tâm huấn luyện và bồi dưỡng nghiệp vụ, cơ sở an dưỡng, điều dưỡng, nghỉ dưỡng và phục hồi chức năng, cơ sở khám bệnh, chữa bệnh của lực lượng vũ trang nhân dân;

Used as training facilities, training and professional development centers, convalescent, rehabilitation, and recovery centers, as well as medical examination and treatment facilities for the people’s armed forces.

+ Sử dụng làm nhà ở công vụ của lực lượng vũ trang nhân dân;

Used as official residences for the people’s armed forces.

Used as detention facilities; temporary detention and holding facilities; compulsory education facilities; reform schools; and labor, rehabilitation, vocational training centers for inmates, detainees, and students under the management of the Ministry of Defense and the Ministry of Public Security.

2.1. Cases of land recovery for economic and social development for national and public interests?

Thu hồi đất để phát triển kinh tế – xã hội vì lợi ích quốc gia, công cộng?

Nhà nước thu hồi đất để phát triển kinh tế – xã hội vì lợi ích quốc gia, công cộng trong các trường hợp sau đây theo quy định tại Điều 79 của Luật Đất đai 2024:

The State recovers land for economic and social development for national and public interests in the following cases as stipulated in Article 79 of the 2024 Land Law:

+ Xây dựng công trình giao thông, bao gồm: đường ô tô cao tốc, đường ô tô, đường trong đô thị, đường nông thôn kể cả đường tránh, đường cứu nạn và đường trên đồng ruộng phục vụ nhu cầu đi lại chung của mọi người, điểm dừng xe, điểm đón trả khách, trạm thu phí giao thông, công trình kho bãi, nhà để xe ô tô; bến phà, bến xe, trạm dừng nghỉ; các loại hình đường sắt; nhà ga đường sắt; các loại cầu, hầm phục vụ giao thông; công trình đường thủy nội địa, công trình hàng hải; công trình hàng không; tuyến cáp treo và nhà ga cáp treo; cảng cá, cảng cạn; các công trình trụ sở, văn phòng, cơ sở kinh doanh dịch vụ trong ga, cảng, bến xe; hành lang bảo vệ an toàn công trình giao thông mà phải thu hồi đất để lưu không; các kết cấu khác phục vụ giao thông vận tải;

Construction of transportation infrastructure, including: highways, roads, urban roads, rural roads, including bypasses, rescue roads, and roads on farmland to meet general transportation needs; parking areas, passenger pick-up and drop-off points, toll stations, storage facilities, car garages; ferry terminals, bus stations, rest stops; various types of railways; railway stations; various types of bridges and tunnels for transportation; inland waterway projects, maritime projects; aviation projects; cable car lines and cable car stations; fishing ports, dry ports; office buildings, service facilities within stations, ports, and bus terminals; safety protection corridors for transportation infrastructure requiring land recovery for clearance; and other structures serving transportation.

+ Xây dựng công trình thủy lợi, bao gồm: đê điều, kè, cống, đập, tràn xả lũ, hồ chứa nước, đường hầm thủy công, hệ thống cấp nước, thoát nước, tưới nước, tiêu nước kể cả hành lang bảo vệ công trình thủy lợi mà phải sử dụng đất; công trình thủy lợi đầu mối kể cả nhà làm việc, nhà kho, cơ sở sản xuất, sửa chữa, bảo dưỡng công trình thủy lợi thuộc phạm vi công trình thủy lợi;

Construction of irrigation works, including: embankments, dykes, sluices, dams, flood overflow weirs, reservoirs, hydraulic tunnels, and systems for water supply, drainage, irrigation, and land reclamation, including protection corridors for irrigation works that require land use; key irrigation projects, including offices, warehouses, and facilities for production, repair, and maintenance of irrigation infrastructure within the scope of the irrigation project.

+ Xây dựng công trình cấp nước, thoát nước, bao gồm: nhà máy nước; trạm bơm nước; bể, tháp chứa nước; tuyến ống cấp nước, thoát nước; hồ điều hòa; công trình xử lý nước, bùn, bùn cặn kể cả nhà làm việc, nhà kho, cơ sở sản xuất, sửa chữa, bảo dưỡng công trình cấp nước, thoát nước;

Construction of water supply and drainage infrastructure, including: water treatment plants; pumping stations; water tanks and towers; water supply and drainage pipelines; balancing reservoirs; water, sludge, and sediment treatment facilities, including offices, warehouses, and facilities for the production, repair, and maintenance of water supply and drainage infrastructure.

+ Xây dựng công trình xử lý chất thải, bao gồm: trạm trung chuyển; bãi chôn lấp rác; khu liên hợp xử lý, khu xử lý, cơ sở xử lý chất thải, chất thải nguy hại kể cả nhà làm việc, nhà kho, cơ sở sản xuất, sửa chữa, bảo dưỡng công trình xử lý chất thải;

Construction of waste treatment facilities, including: transfer stations; landfills; integrated treatment complexes; treatment areas; waste treatment facilities, including hazardous waste treatment; as well as offices, warehouses, and facilities for the production, repair, and maintenance of waste treatment infrastructure.

+ Xây dựng công trình năng lượng, chiếu sáng công cộng, bao gồm: nhà máy điện và công trình phụ trợ của nhà máy điện; công trình đập, kè, hồ chứa nước, đường dẫn nước phục vụ cho nhà máy thủy điện; hệ thống đường dây truyền tải điện và trạm biến áp; công trình kinh doanh dịch vụ, sửa chữa, bảo dưỡng thuộc phạm vi nhà máy điện; hệ thống chiếu sáng công cộng;

Construction of energy and public lighting infrastructure, including: power plants and associated auxiliary facilities; dams, embankments, reservoirs, and water conduits for hydroelectric power plants; electrical transmission lines and substations; service facilities for business, repair, and maintenance within the power plant; and public lighting systems.

+ Xây dựng công trình dầu khí, bao gồm: giàn khai thác, công trình phục vụ khai thác, xử lý dầu khí, nhà máy lọc hóa dầu, nhà máy chế biến khí, nhà máy sản xuất nhiên liệu sinh học; kho chứa dầu thô, kho chứa, trạm bơm xăng, dầu, khí, hệ thống đường ống dẫn, hành lang bảo vệ an toàn công trình để bảo đảm an toàn kỹ thuật; công trình kinh doanh dịch vụ, sửa chữa, bảo dưỡng thuộc phạm vi công trình phục vụ khai thác, xử lý dầu, khí, nhà máy lọc hóa dầu, nhà máy chế biến khí, nhà máy sản xuất nhiên liệu sinh học;

Construction of oil and gas infrastructure, including: extraction platforms, facilities for extraction and processing of oil and gas, petrochemical refineries, gas processing plants, and biofuel production plants; crude oil storage tanks, storage facilities, gasoline, oil, and gas pumping stations, pipeline systems, and safety protection corridors to ensure technical safety; as well as service facilities for business, repair, and maintenance within the scope of oil and gas extraction and processing facilities, petrochemical refineries, gas processing plants, and biofuel production plants.

+ Xây dựng công trình hạ tầng bưu chính, viễn thông, công nghệ thông tin, bao gồm: nhà, trạm, cột ăng ten, cột treo cáp, cống, bể, ống cáp, hào, tuy nen kỹ thuật và công trình hạ tầng kỹ thuật liên quan khác để lắp đặt thiết bị phục vụ viễn thông và thiết bị được lắp đặt vào đó để phục vụ viễn thông; trung tâm dữ liệu; kể cả hành lang bảo vệ an toàn các công trình để bảo đảm an toàn kỹ thuật mà không được sử dụng vào mục đích khác; hệ thống cơ sở khai thác bưu gửi và điểm phục vụ bưu chính; điểm bưu điện – văn hóa xã; công trình kinh doanh dịch vụ, sửa chữa, bảo dưỡng thuộc phạm vi công trình bưu chính, viễn thông, công nghệ thông tin;

Construction of postal, telecommunications, and information technology infrastructure, including: buildings, stations, antenna masts, cable poles, conduits, tanks, cable ducts, trenches, technical tunnels, and other related technical infrastructure for installing telecommunications equipment and the equipment itself; data centers; including safety protection corridors for technical safety that are not used for other purposes; mail processing facilities and postal service points; postal-cultural centers; as well as service facilities for business, repair, and maintenance within the scope of postal, telecommunications, and information technology infrastructure.

+ Xây dựng chợ dân sinh, chợ đầu mối;

Construction of local markets and wholesale markets;

+ Xây dựng công trình tín ngưỡng, bao gồm: đình, đền, am, miếu và công trình tín ngưỡng hợp pháp khác;

Construction of religious facilities, including: communal houses, temples, shrines, pagodas, and other legal religious structures.

+ Xây dựng công trình tôn giáo, bao gồm: trụ sở của tổ chức tôn giáo, tổ chức tôn giáo trực thuộc; chùa, nhà thờ, nhà nguyện, thánh đường, thánh thất; trường đào tạo người chuyên hoạt động tôn giáo; tượng đài, bia, tháp và công trình tôn giáo hợp pháp khác;

Construction of religious facilities, including: headquarters of religious organizations, affiliated religious organizations; temples, churches, chapels, mosques, and worship halls; training centers for religious professionals; monuments, steles, pagodas, and other legal religious structures.

+ Xây dựng khu vui chơi, giải trí công cộng, sinh hoạt cộng đồng, bao gồm: công viên, vườn hoa, bãi tắm và khu vực dành cho vui chơi giải trí công cộng khác; công trình hội họp và hoạt động khác phù hợp với phong tục, tập quán của cộng đồng dân cư ở địa phương;

Construction of public recreational and community activity areas, including: parks, gardens, beaches, and other areas for public recreation; meeting facilities and other activities that align with the customs and traditions of the local community.

+ Xây dựng trụ sở cơ quan Đảng Cộng sản Việt Nam, cơ quan nhà nước, Mặt trận Tổ quốc Việt Nam, tổ chức chính trị – xã hội, tổ chức chính trị xã hội – nghề nghiệp, tổ chức xã hội – nghề nghiệp, tổ chức xã hội và tổ chức khác thành lập theo quy định của pháp luật được Nhà nước giao nhiệm vụ, hỗ trợ kinh phí hoạt động thường xuyên;

Construction of headquarters for the Communist Party of Vietnam, state agencies, the Vietnam Fatherland Front, political-social organizations, political-social-professional organizations, social-professional organizations, social organizations, and other entities established according to legal regulations and assigned tasks or supported with operational funding by the State.

+ Xây dựng trụ sở hoặc văn phòng đại diện của các đơn vị sự nghiệp công lập trực thuộc cơ quan Đảng Cộng sản Việt Nam, cơ quan nhà nước, tổ chức chính trị – xã hội;

Construction of headquarters or representative offices for public service units affiliated with the Communist Party of Vietnam, state agencies, and political-social organizations.

Construction of cultural facilities, historical-cultural sites, and scenic spots, including: conference centers, theaters, cultural houses, cultural centers, cultural palaces, clubs, cinemas, and circuses; historical monuments; symbolic and artistic structures, children’s palaces, youth centers, museums, exhibition halls, libraries, literary creation facilities, art creation facilities, art galleries, and headquarters for performing arts groups; expansion, renovation, restoration, and enhancement of historical-cultural sites and scenic spots that have been classified or listed by provincial People’s Committees according to cultural heritage regulations; and other cultural facilities established or authorized by the State.

+ Xây dựng cơ sở y tế, cơ sở dịch vụ xã hội được Nhà nước thành lập hoặc cho phép hoạt động, bao gồm: cơ sở khám bệnh, chữa bệnh; cơ sở phục hồi chức năng; cơ sở y tế dự phòng; cơ sở dân số; cơ sở kiểm nghiệm; cơ sở kiểm chuẩn, kiểm định; cơ sở giám định y khoa; cơ sở giám định pháp y; cơ sở sản xuất thuốc; cơ sở sản xuất thiết bị y tế; trung tâm cung cấp dịch vụ công tác xã hội, cơ sở bảo trợ xã hội; trung tâm chữa bệnh, giáo dục, lao động xã hội; trung tâm điều dưỡng người có công; cơ sở trợ giúp trẻ em; cơ sở tham vấn, tư vấn chăm sóc người cao tuổi, người khuyết tật, trẻ em có hoàn cảnh đặc biệt, người nhiễm HIV/AIDS, người tâm thần; cơ sở cai nghiện ma túy; cơ sở nuôi dưỡng người già, trẻ em có hoàn cảnh đặc biệt;

Construction of healthcare and social service facilities established or authorized by the State, including: medical examination and treatment facilities; rehabilitation centers; preventive healthcare facilities; population centers; testing facilities; calibration and certification facilities; medical forensic centers; forensic examination facilities; drug production facilities; medical device manufacturing facilities; social work service centers; social welfare institutions; centers for treatment, education, and social labor; centers for the care of individuals with meritorious services; child assistance facilities; consultation and counseling centers for elderly care, individuals with disabilities, children in special circumstances, HIV/AIDS patients, and individuals with mental health issues; drug rehabilitation centers; and facilities for the care of the elderly and children in special circumstances.

+ Xây dựng cơ sở giáo dục, đào tạo được Nhà nước thành lập hoặc cho phép hoạt động, bao gồm: nhà trẻ, trường mẫu giáo, trường mầm non, cơ sở giáo dục phổ thông, cơ sở giáo dục thường xuyên, trường chuyên biệt, cơ sở giáo dục đại học, cơ sở giáo dục nghề nghiệp;

Construction of educational and training facilities established or authorized by the State, including: nurseries, kindergartens, preschools, general education institutions, continuing education facilities, special education schools, higher education institutions, and vocational education centers.

+ Xây dựng cơ sở thể dục, thể thao do Nhà nước thành lập hoặc cho phép hoạt động, bao gồm: khu liên hợp thể thao, trung tâm đào tạo, huấn luyện vận động viên thể thao; sân vận động, cơ sở thi đấu, tập luyện các môn thể thao;

Construction of sports facilities established or authorized by the State, including: sports complexes, training centers for athletes; stadiums, competition venues, and training facilities for various sports.

+ Xây dựng cơ sở khoa học và công nghệ do Nhà nước thành lập hoặc cho phép hoạt động, bao gồm: tổ chức nghiên cứu, phát triển, dịch vụ khoa học và công nghệ; tổ chức hỗ trợ khởi nghiệp đổi mới sáng tạo; cơ sở ươm tạo công nghệ, cơ sở ươm tạo doanh nghiệp khoa học và công nghệ; công viên khoa học, công nghệ; bảo tàng khoa học; hệ thống chuẩn đo lường;

Construction of scientific and technological facilities established or authorized by the State, including: research and development organizations, science and technology service organizations; organizations supporting innovative startups; technology incubation centers, science and technology business incubation centers; science and technology parks; science museums; and measurement calibration systems.

+ Xây dựng cơ sở ngoại giao, bao gồm: trụ sở của các đại sứ quán, lãnh sự quán, văn phòng đại diện của các tổ chức ngoại giao nước ngoài, các tổ chức phi Chính phủ có chức năng ngoại giao; cơ sở ngoại giao đoàn do Nhà nước quản lý;

Construction of diplomatic facilities, including: headquarters of embassies, consulates, representative offices of foreign diplomatic organizations, and non-governmental organizations with diplomatic functions; diplomatic mission facilities managed by the State.

+ Xây dựng công trình sự nghiệp về xử lý môi trường, bảo tồn đa dạng sinh học, khí tượng, thủy văn, đăng kiểm, kiểm dịch động vật, thực vật;

Construction of facilities for environmental management, biodiversity conservation, meteorology, hydrology, registration, and quarantine of animals and plants.

+ Thực hiện dự án đầu tư xây dựng nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, trừ trường hợp thỏa thuận về nhận quyền sử dụng đất; dự án đầu tư xây dựng nhà ở công vụ; dự án đầu tư cải tạo, xây dựng lại nhà chung cư, trừ trường hợp chủ sở hữu nhà chung cư thỏa thuận chuyển nhượng quyền sử dụng đất cho chủ đầu tư để thực hiện dự án đầu tư cải tạo, xây dựng lại nhà chung cư theo quy định của Luật Nhà ở; dự án tái định cư;

Implement investment projects for the construction of social housing, housing for the people’s armed forces, except in cases where there is an agreement on land use rights; investment projects for the construction of government housing; investment projects for the renovation or reconstruction of apartment buildings, except when apartment owners agree to transfer land use rights to the investor for such projects according to the Housing Law; and resettlement projects.

+ Thực hiện dự án khu công nghiệp, cụm công nghiệp; khu công nghệ cao; khu nông nghiệp ứng dụng công nghệ cao; khu công nghệ thông tin tập trung; khu lâm nghiệp ứng dụng công nghệ cao; khu phi thuế quan trong khu kinh tế;

Implement investment projects for industrial zones, industrial clusters; high-tech zones; high-tech agricultural zones; concentrated information technology zones; high-tech forestry zones; and free trade zones within economic zones.

+ Thực hiện dự án khu sản xuất, chế biến nông sản, lâm sản, thủy sản, hải sản tập trung có quy mô lớn, tập trung đồng bộ về kết cấu hạ tầng dùng chung từ khâu sản xuất đến chế biến nông sản, lâm sản, thủy sản, hải sản phục vụ trên phạm vi liên huyện, liên tỉnh hoặc liên vùng; dự án trồng, bảo tồn gen cây thuốc để phát triển dược liệu y học cổ truyền;

Implement investment projects for large-scale, integrated production and processing zones for agricultural products, forestry products, aquatic products, and seafood, with comprehensive infrastructure from production to processing, serving multiple districts, provinces, or regions; and projects for growing and preserving medicinal plant genetics for traditional medicine development.

+ Thực hiện hoạt động lấn biển;

+ Hoạt động khai thác khoáng sản đã được cơ quan nhà nước có thẩm quyền cấp phép, kể cả hạng mục công trình phục vụ cho việc khai thác, chế biến khoáng sản gắn với khu vực khai thác và hành lang bảo vệ an toàn cho việc khai thác mà phải thu hồi đất;

Mineral extraction activities that have been authorized by competent state agencies, including construction components related to the extraction and processing of minerals in the extraction area and safety protection corridors, which require land reclamation.

+ Dự án vùng phụ cận các điểm kết nối giao thông và các tuyến giao thông có tiềm năng phát triển;

Projects in the areas surrounding transportation hubs and routes with development potential.

+ Thực hiện dự án đầu tư xây dựng khu đô thị có công năng phục vụ hỗn hợp, đồng bộ hệ thống hạ tầng kỹ thuật, hạ tầng xã hội với nhà ở theo quy định của pháp luật về xây dựng để xây dựng mới hoặc cải tạo, chỉnh trang đô thị; dự án khu dân cư nông thôn;

Implement investment projects for constructing mixed-use urban areas, with integrated technical and social infrastructure systems and housing according to construction regulations, for new developments or urban renewal; and rural residential area projects.

+ Nghĩa trang, nhà tang lễ, cơ sở hỏa táng, cơ sở lưu giữ tro cốt;

Cemeteries, funeral homes, crematoriums, and facilities for the storage of ashes.

+ Thực hiện dự án bố trí đất ở, đất sản xuất cho đồng bào dân tộc thiểu số để thực hiện chính sách đất đai đối với đồng bào dân tộc thiểu số theo quy định của Luật này;

Implement projects to allocate residential and agricultural land for ethnic minorities to apply land policies for ethnic minorities as stipulated by this Law.

+ Xây dựng công trình trên mặt đất phục vụ cho việc vận hành, khai thác, sử dụng công trình ngầm;

Construct above-ground facilities for the operation, exploitation, and use of underground structures.

+ Thực hiện dự án đã được Quốc hội, Thủ tướng Chính phủ chấp thuận, quyết định chủ trương đầu tư theo quy định của pháp luật;

Implement projects approved by the National Assembly or the Prime Minister, with investment decisions made according to legal regulations.

+ Trường hợp thu hồi đất để thực hiện dự án, công trình vì lợi ích quốc gia, công cộng không thuộc các trường hợp quy định từ khoản 1 đến khoản 31 của Điều này thì Quốc hội sửa đổi, bổ sung các trường hợp thu hồi đất của Điều này theo trình tự, thủ tục rút gọn.

In cases where land is reclaimed for projects or works for national or public interests that are not covered by items 1 to 31 of this Article, the National Assembly shall amend or supplement the land reclamation cases in this Article through a streamlined procedure.

2.2. Land reclamation due to violations of land law?

Land reclamation due to violations of land law?

Nhà nước thu hồi đất do vi phạm pháp luật về đất đai trong các trường hợp sau đây theo quy định tại Điều 781 của Luật Đất đai 2024:

The State reclaims land due to violations of land law in the following cases as stipulated in Article 78 of the Land Law 2024:

+ Sử dụng đất không đúng mục đích đã được Nhà nước giao, cho thuê, công nhận quyền sử dụng đất và đã bị xử phạt vi phạm hành chính về hành vi sử dụng đất không đúng mục đích mà tiếp tục vi phạm.

Using land for purposes other than those for which it was allocated, leased, or recognized by the State, and continuing to violate after being fined for administrative violations related to improper land use.

+ Người sử dụng đất hủy hoại đất và đã bị xử phạt vi phạm hành chính về hành vi hủy hoại đất mà tiếp tục vi phạm.

A land user who damages the land and continues to violate regulations after having been fined for administrative offenses related to land degradation.

+ Đất được giao, cho thuê không đúng đối tượng hoặc không đúng thẩm quyền.

Land allocated or leased to the wrong entity or beyond the authorized authority.

+ Đất do nhận chuyển nhượng, nhận tặng cho từ người được Nhà nước giao đất, cho thuê đất mà người được giao đất, cho thuê đất không được chuyển nhượng, tặng cho theo quy định của Luật này.

Land acquired through transfer or donation from someone who was granted or leased the land by the State, where the original grantee or lessee is not permitted to transfer or donate it according to the provisions of this Law.

+ Đất được Nhà nước giao quản lý mà để bị lấn đất, chiếm đất.

Land allocated for management by the State that has been encroached upon or occupied.

+  Người sử dụng đất không thực hiện nghĩa vụ tài chính với Nhà nước.

Land users who do not fulfill their financial obligations to the State.

+ Đất trồng cây hằng năm, đất nuôi trồng thủy sản không được sử dụng trong thời gian 12 tháng liên tục, đất trồng cây lâu năm không được sử dụng trong thời gian 18 tháng liên tục, đất trồng rừng không được sử dụng trong thời gian 24 tháng liên tục và đã bị xử phạt vi phạm hành chính mà không đưa đất vào sử dụng theo thời hạn ghi trong quyết định xử phạt vi phạm hành chính;

Land for annual crops or aquaculture that has not been used for a continuous period of 12 months, land for perennial crops that has not been used for a continuous period of 18 months, and forest land that has not been used for a continuous period of 24 months, and has been fined for administrative violations but has not been put into use within the time frame specified in the administrative penalty decision.

+ Đất được Nhà nước giao, cho thuê, cho phép chuyển mục đích sử dụng, công nhận quyền sử dụng đất, nhận chuyển nhượng quyền sử dụng đất để thực hiện dự án đầu tư mà không được sử dụng trong thời hạn 12 tháng liên tục kể từ khi nhận bàn giao đất trên thực địa hoặc tiến độ sử dụng đất chậm 24 tháng so với tiến độ ghi trong dự án đầu tư; trường hợp không đưa đất vào sử dụng hoặc chậm tiến độ sử dụng đất so với tiến độ ghi trong dự án đầu tư thì chủ đầu tư được gia hạn sử dụng không quá 24 tháng và phải nộp bổ sung cho Nhà nước khoản tiền tương ứng với mức tiền sử dụng đất, tiền thuê đất đối với thời gian được gia hạn; hết thời hạn được gia hạn mà chủ đầu tư vẫn chưa đưa đất vào sử dụng thì Nhà nước thu hồi đất mà không bồi thường về đất, tài sản gắn liền với đất và chi phí đầu tư vào đất còn lại.

Land allocated, leased, or permitted for a change of use by the State, or recognized for use rights, or acquired for an investment project that has not been utilized for a continuous period of 12 months from the date of land handover, or has a delay in land use of 24 months compared to the schedule specified in the investment project, will be subject to the following: If the land is not used or if there is a delay in land use compared to the project schedule, the investor may be granted an extension of use for up to 24 months and must pay additional fees to the State corresponding to the land use or lease fees for the extended period. Nhà nước thu hồi do chấm dứt việc sử dụng đất theo pháp luật, tự nguyện trả lại đất, có nguy cơ đe dọa tính mạng con người, không còn khả năng tiếp tục sử dụng trong các trường hợp sau đây theo quy định tại Điều 81 của Luật Đất đai 2024:

Các trường hợp thu hồi đất do chấm dứt việc sử dụng đất theo pháp luật bao gồm:

Cases of land recovery due to the termination of land use according to the law include,

+ Tổ chức được Nhà nước giao đất không thu tiền sử dụng đất bị giải thể, phá sản hoặc bị chấm dứt hoạt động theo quy định của pháp luật;

Organizations that are allocated land by the State without land use fees and are dissolved, bankrupt, or have their operations terminated according to the law.

+ Cá nhân sử dụng đất chết mà không có người nhận thừa kế sau khi đã thực hiện nghĩa vụ về tài sản theo quy định của pháp luật về dân sự;

+ Đất được Nhà nước giao, cho thuê có thời hạn nhưng không được gia hạn sử dụng đất;

Land allocated or leased by the State for a fixed term but not granted an extension for land use;

+ Thu hồi đất trong trường hợp chấm dứt dự án đầu tư theo quy định của pháp luật về đầu tư;

Recovery of land in cases of termination of investment projects according to investment law regulations.

+ Thu hồi đất trong trường hợp đã bị thu hồi rừng theo quy định của pháp luật về lâm nghiệp.

Người sử dụng đất giảm hoặc không còn nhu cầu sử dụng đất và có đơn tự nguyện trả lại đất.

The land user has reduced or no longer has a need for the land and has voluntarily submitted a request to return it.

Các trường hợp thu hồi đất do có nguy cơ đe dọa tính mạng con người hoặc không còn khả năng tiếp tục sử dụng bao gồm:

+ Đất ở trong khu vực bị ô nhiễm môi trường có nguy cơ đe dọa tính mạng con người; đất khác trong khu vực bị ô nhiễm môi trường không còn khả năng tiếp tục sử dụng theo mục đích đã xác định;

Residential land in areas with environmental pollution posing a threat to human life; other land in areas with environmental pollution that can no longer be used for its intended purpose.

Residential land at risk of landslides, subsidence, or affected by other natural disasters threatening human life; other land that has experienced landslides, subsidence, or is affected by other natural disasters and can no longer be used.

Thu hồi đất đối với các trường hợp phải thu hồi đất theo quy định tại khoản 1 Điều 48, điểm d và điểm đ khoản 1 Điều 181 Luật Đất đai 2024.
