a) Không có di chúc;
b) Di chúc không hợp pháp;
c) Những người thừa kế theo di chúc chết trước hoặc chết cùng thời điểm với người lập di chúc; cơ quan, tổ chức được hưởng thừa kế theo di chúc không còn tồn tại vào thời điểm mở thừa kế;

The following article discusses legal matters relating to whether the eldest child is entitled to inherit all assets left by the parents when there is no will, how the assets are distributed when the parents die without leaving a will, and whether the eldest child has priority in receiving the assets. The information is provided by Tuyet Nhung Bui Law Firm for reference purposes only.
If there is no will, can the eldest child inherit all of the parents’ assets?
When parents pass away without leaving a will, many families often believe that the eldest child, because they are responsible for taking care of and managing their parents’ house and land, may be entitled to receive all of the assets. However, being the eldest child does not automatically give that person the right to inherit the entire estate. Where there is no valid will, the deceased’s estate will, in principle, be handled in accordance with the provisions on intestate succession.
So, when parents pass away and there are several children in the family, how will the assets be divided? Can the eldest child receive the entire house and land left by the parents?
How are assets divided when parents die without leaving a will?
Pursuant to Clause 1, Article 650 of the 2015 Civil Code, intestate succession applies in the following cases:
Accordingly, where parents pass away without leaving a will, their estate will be distributed according to the law. In such cases, the persons entitled to inherit the estate will be determined based on the order of heirs prescribed by law.
However, when parents pass away, not all of the house and land registered in their names will necessarily be divided immediately among their children. If the father dies first, it is necessary to first determine which portion of the assets belongs to the father and which portion belongs to the mother. Only the assets belonging to the father will be identified as his estate for inheritance purposes. Subsequently, if the mother also passes away, the assets belonging to the mother will become her estate, and the persons entitled to inherit will then be determined at the time of her death.
Therefore, determining how much each child is entitled to receive does not depend solely on the number of children. It is also necessary to consider the origin of the assets, ownership rights over the assets, and the time at which each parent passed away.
For example: If the house and land are jointly owned by the father and mother, when one of them dies, in principle, only that person’s share of the property rights will be included in the estate. The portion of the assets belonging to the surviving person remains their property and is not part of the estate to be distributed among the children.
Where both the father and mother have passed away, it is also necessary to consider the time of each person’s death in order to determine the estate of each person and the heirs at each relevant time. This determination may directly affect the proportion of the estate that each child is entitled to receive.
Does the eldest child have priority to receive the assets?
Inheritance law does not provide that the eldest child has priority over other children merely because they are the first-born or oldest child. Where parents die without leaving a will, the eldest child is also simply identified as one of the persons belonging to the first line of heirs and, in principle, is entitled to an equal share of the estate with the other heirs in the same line.
Pursuant to Clause 2, Article 651 of the 2015 Civil Code: “Heirs in the same line shall receive equal shares of the estate.”
For example, after determining the portion of the assets belonging to the deceased, suppose the remaining estate is worth VND 3 billion and there are exactly three children who are heirs in the same line. If there is no case of representation inheritance or any other issue that changes the number of persons entitled to inherit, each person would, in principle, be entitled to VND 1 billion. Therefore, the eldest child is not automatically entitled to the entire VND 3 billion merely because they are the oldest child. The estate must, in principle, still be determined and distributed among the persons entitled to inherit in accordance with the law.
Although the eldest child does not automatically have the right to receive the entire estate, they may still receive the entire house and land if the persons entitled to inherit agree that the eldest child will receive the house and land and pay the other co-heirs the value of their respective inheritance shares.
For example, suppose the parents leave a house and land use rights, while all three children have equal inheritance rights. If the other two children agree to let the eldest child receive the entire house and land, the parties may prepare a written agreement on the distribution of the estate, under which the eldest child receives the house and land, while the other two children receive the corresponding value of the estate to which they are entitled.
If no agreement can be reached, each co-heir has the right to request the Court to divide the estate in accordance with Article 660 of the 2015 Civil Code.
Accordingly, if the assets can be divided into appropriate portions, the heirs may consider dividing the assets in kind.
If the parties cannot agree on who will receive the assets or on a method for paying the value of the inheritance shares to the remaining heirs, the assets may be handled by way of sale, with the proceeds distributed among the co-heirs according to their respective rights.
Where a dispute arises and the parties are unable to reach an agreement on their own, a person with relevant rights and interests may request the Court to resolve the distribution of the estate in accordance with the law.
