1. Quy định pháp luật là gì?
Quy định pháp luật là những quy tắc xử sự chung do Nhà nước ban hành hoặc thừa nhận và bảo đảm thực hiện, nhằm điều chỉnh các quan hệ xã hội theo ý chí của Nhà nước.
Nói đơn giản, quy định pháp luật là những điều mà pháp luật quy định mọi cá nhân, tổ chức phải tuân theo hoặc được phép thực hiện.
2. Những quy định pháp luật mới có hiệu lực từ tháng 8/2026?
2.1. Quy định pháp luật về đất đai
Nghị định 281/2026/NĐ-CP có hiệu lực với 04 điểm mới:
Từ ngày 31/8/2026, Nghị định 281/2026/NĐ-CP chính thức có hiệu lực, sửa đổi, bổ sung một số quy định của Nghị định 123/2024/NĐ-CP về xử phạt vi phạm hành chính trong lĩnh vực đất đai. Nghị định mới mang đến nhiều thay đổi quan trọng liên quan đến đối tượng bị xử phạt, biện pháp khắc phục hậu quả, thẩm quyền xử phạt và mức phạt đối với một số hành vi vi phạm.
Thứ nhất, Vợ chồng có chung quyền sử dụng đất bị xử phạt như một cá nhân
Một trong những điểm mới đáng chú ý của Nghị định 281/2026/NĐ-CP là quy định trường hợp vợ và chồng cùng có quyền sử dụng đất thì khi xảy ra vi phạm hành chính sẽ được áp dụng mức xử phạt như đối với một cá nhân.
Trước đây, Nghị định 123/2024/NĐ-CP chưa có quy định riêng đối với trường hợp này. Văn bản chỉ quy định cá nhân, hộ gia đình, cộng đồng dân cư và tổ chức là các đối tượng bị xử phạt, trong đó hộ gia đình và cộng đồng dân cư được áp dụng mức xử phạt tương tự cá nhân.
Theo quy định mới, nếu hành vi vi phạm phát sinh trên thửa đất thuộc quyền sử dụng chung của vợ chồng thì việc xác định mức phạt sẽ được thực hiện như đối với một cá nhân. Tuy nhiên, tùy theo tính chất của hành vi vi phạm, người vi phạm vẫn phải thực hiện các biện pháp khắc phục hậu quả như đăng ký đất đai theo quy định, khôi phục hiện trạng ban đầu của đất, nộp lại khoản lợi bất hợp pháp hoặc thực hiện các biện pháp khác theo quy định của pháp luật.
Thứ hai, Bổ sung biện pháp khắc phục hậu quả đối với hành vi sử dụng giấy tờ đất giả hoặc bị tẩy xóa
Điều 2 Nghị định 281/2026/NĐ-CP đã bổ sung nhiều biện pháp khắc phục hậu quả đối với hành vi sử dụng giấy tờ về đất đai bị tẩy xóa, sửa chữa hoặc làm giả.
Cụ thể, người vi phạm có thể bị áp dụng một hoặc nhiều biện pháp sau:
Buộc khôi phục lại hiện trạng ban đầu của đất trước khi xảy ra vi phạm.
Buộc khôi phục lại tình trạng ban đầu của mốc địa giới đơn vị hành chính.
Buộc thực hiện lại thủ tục hành chính về đất đai theo đúng quy định.
Buộc nộp lại giấy tờ đã bị tẩy xóa, sửa chữa, làm sai lệch nội dung hoặc giấy tờ giả đã sử dụng.
Đáng chú ý, thay vì áp dụng hình thức xử phạt bổ sung là tịch thu giấy tờ giả hoặc giấy tờ bị tẩy xóa như trước đây, Nghị định 281/2026/NĐ-CP đã bãi bỏ quy định này và thay thế bằng biện pháp buộc nộp lại các giấy tờ vi phạm. Sự thay đổi này góp phần hoàn thiện cơ chế xử lý đối với các hành vi gian lận trong quá trình thực hiện thủ tục đất đai.
Thứ ba, Chủ tịch UBND cấp xã được tăng mạnh thẩm quyền xử phạt
Kể từ ngày 31/8/2026, thẩm quyền xử phạt vi phạm hành chính trong lĩnh vực đất đai của Chủ tịch UBND cấp xã được nâng lên đáng kể.
Theo quy định mới, mức phạt tiền tối đa thuộc thẩm quyền của Chủ tịch UBND cấp xã tăng từ 5 triệu đồng lên 250 triệu đồng, tương đương tăng gấp 50 lần so với trước đây.
Ngoài quyền phạt tiền, Chủ tịch UBND cấp xã còn được áp dụng các hình thức xử lý khác như:
Phạt cảnh cáo.
Đình chỉ hoạt động dịch vụ tư vấn trong thời hạn tối đa 03 tháng.
Áp dụng các biện pháp khắc phục hậu quả theo quy định của pháp luật về xử phạt vi phạm hành chính trong lĩnh vực đất đai.
Thứ tư, Không đăng ký biến động đất đai có thể bị phạt đến 3 triệu đồng
Theo quy định tại khoản 2 Điều 16 Nghị định 123/2024/NĐ-CP được sửa đổi, bổ sung bởi Nghị định 281/2026/NĐ-CP, từ ngày 31/8/2026, cá nhân không thực hiện đăng ký biến động đất đai trong các trường hợp pháp luật quy định có thể bị xử phạt từ 2 triệu đồng đến 3 triệu đồng.
Mức xử phạt này áp dụng đối với các trường hợp không đăng ký biến động đất đai theo các điểm a, b, i, k, l, m và q khoản 1 Điều 133 Luật Đất đai, ngoại trừ trường hợp nhận quyền sử dụng đất để thực hiện dự án đầu tư thông qua thỏa thuận nhận quyền sử dụng đất theo Điều 127 Luật Đất đai.
Việc bổ sung và điều chỉnh các quy định nêu trên nhằm tăng hiệu quả quản lý nhà nước về đất đai, đồng thời nâng cao tính răn đe đối với các hành vi vi phạm, góp phần bảo đảm việc sử dụng đất đúng quy định của pháp luật.
2.2. Quy định pháp luật về tư pháp, toà án
Từ tháng 8/2026, nhiều quy định pháp luật mới chính thức được áp dụng, trong đó nổi bật là nội quy phiên tòa mới và Pháp lệnh về trình tự, thủ tục đưa người từ đủ 12 đến dưới 18 tuổi đi cai nghiện bắt buộc. Những quy định này góp phần tăng cường kỷ luật tại phiên tòa và hoàn thiện cơ chế xử lý đối với người nghiện ma túy chưa thành niên.
Thứ nhất, Ban hành nội quy phiên tòa mới
Theo Thông tư 12/2026/TT-TANDTC, nội quy phiên tòa có nhiều điểm mới nhằm bảo đảm trật tự, an ninh và tính nghiêm minh trong quá trình xét xử.
Một số nội dung đáng chú ý gồm:
+ Không được mang điện thoại di động, máy tính bảng hoặc các thiết bị có chức năng ghi hình vào phòng xử án nếu chưa được cơ quan có thẩm quyền cho phép.
+ Quy định cụ thể về việc ghi âm, ghi hình trong suốt quá trình diễn ra phiên tòa.
Bổ sung quy định về trách nhiệm của người tham gia tố tụng trong việc chấp hành nội quy và bảo đảm trật tự tại phiên tòa.
Các quy định mới được kỳ vọng sẽ góp phần nâng cao tính chuyên nghiệp, công khai và minh bạch trong hoạt động xét xử của Tòa án.
Thứ hai, Áp dụng Pháp lệnh mới về cai nghiện bắt buộc đối với người từ đủ 12 đến dưới 18 tuổi
Từ ngày 01/8/2026, Pháp lệnh số 03/2026/UBTVQH16 về trình tự, thủ tục để Tòa án nhân dân xem xét, quyết định việc đưa người nghiện ma túy từ đủ 12 tuổi đến dưới 18 tuổi đi cai nghiện bắt buộc chính thức có hiệu lực.
Pháp lệnh gồm 05 chương, 48 điều, thay thế Pháp lệnh số 01/2022/UBTVQH15, đồng thời bảo đảm sự thống nhất với Luật Phòng, chống ma túy năm 2025.
Theo quy định mới, Tòa án nhân dân sẽ thực hiện việc xem xét và quyết định áp dụng biện pháp đưa người nghiện ma túy từ đủ 12 tuổi đến dưới 18 tuổi đi cai nghiện bắt buộc tại trường giáo dưỡng theo trình tự, thủ tục cụ thể.
Bên cạnh đó, Pháp lệnh cũng bổ sung các quy định về hoãn, miễn và tạm đình chỉ việc chấp hành quyết định đưa đi cai nghiện bắt buộc, phù hợp với các quy định mới của Luật Phòng, chống ma túy năm 2025. Những nội dung này góp phần hoàn thiện cơ sở pháp lý, đồng thời bảo đảm tốt hơn quyền và lợi ích hợp pháp của người chưa thành niên trong quá trình áp dụng biện pháp xử lý hành chính.
2.3. Quy định pháp luật về đầu tư, doanh nghiệp và đấu thầu
Từ tháng 8/2026, nhiều quy định mới trong lĩnh vực đấu thầu, đầu tư, chứng khoán và ngân hàng chính thức có hiệu lực. Đáng chú ý, nhà đầu tư ứng dụng công nghệ cao và công nghệ thân thiện với môi trường sẽ được hưởng ưu đãi khi tham gia đấu thầu theo quy định mới.
Thứ nhất, Nhà đầu tư ứng dụng công nghệ cao được ưu đãi 5% khi đánh giá hồ sơ dự thầu
Theo Nghị định 274/2026/NĐ-CP hướng dẫn thi hành Luật Đấu thầu về lựa chọn nhà đầu tư, một số đối tượng sẽ được áp dụng cơ chế ưu đãi trong quá trình đánh giá hồ sơ dự thầu.
Cụ thể, nhà đầu tư có giải pháp ứng dụng công nghệ tiên tiến, công nghệ cao, công nghệ thân thiện với môi trường hoặc áp dụng kỹ thuật hiện có tốt nhất nhằm giảm thiểu ô nhiễm môi trường đối với các dự án thuộc nhóm có nguy cơ tác động xấu đến môi trường ở mức độ cao theo quy định của pháp luật về bảo vệ môi trường sẽ được cộng mức ưu đãi 5% khi đánh giá hồ sơ dự thầu.
Quy định này nhằm khuyến khích doanh nghiệp đầu tư vào công nghệ hiện đại, thúc đẩy phát triển bền vững và nâng cao hiệu quả bảo vệ môi trường trong các dự án đầu tư.
Thứ hai, Nhiều văn bản mới trong lĩnh vực đầu tư, tài chính có hiệu lực
Bên cạnh Nghị định 274/2026/NĐ-CP, từ tháng 8/2026 còn có nhiều văn bản pháp luật quan trọng bắt đầu được áp dụng, gồm:
Nghị định 274/2026/NĐ-CP hướng dẫn thi hành Luật Đấu thầu về lựa chọn nhà đầu tư.
Quy định ưu đãi đối với nhà đầu tư ứng dụng công nghệ cao, công nghệ xanh và công nghệ thân thiện với môi trường khi đánh giá hồ sơ dự thầu.
Thông tư 80/2026/TT-BTC sửa đổi, bổ sung các quy định về đăng ký công ty đại chúng.
Thông tư 32/2026/TT-NHNN quy định về hoạt động cho vay phục vụ đầu tư ra nước ngoài.
Việc ban hành và đưa vào áp dụng các văn bản này góp phần hoàn thiện khung pháp lý trong lĩnh vực đấu thầu, đầu tư, tài chính và ngân hàng, đồng thời tạo điều kiện thuận lợi cho doanh nghiệp đổi mới công nghệ, nâng cao năng lực cạnh tranh và thúc đẩy phát triển kinh tế theo hướng bền vững.

1. What Are Legal Regulations?
Legal regulations are generally applicable rules of conduct promulgated or recognized by the State and enforced through its authority to govern social relations in accordance with the will of the State.
In simple terms, legal regulations are provisions of law that prescribe what individuals and organizations are required to comply with or are permitted to do.
2. What New Legal Regulations Take Effect from August 2026?
2.1. Land-Related Legal Regulations
Decree No. 281/2026/ND-CP introduces four notable amendments.
Effective from 31 August 2026, Decree No. 281/2026/ND-CP officially takes effect, amending and supplementing certain provisions of Decree No. 123/2024/ND-CP on administrative sanctions for violations in the land sector. The new Decree introduces significant changes relating to entities subject to sanctions, remedial measures, sanctioning authority, and penalties applicable to certain violations.
First, spouses jointly holding land use rights shall be sanctioned as a single individual
One of the notable new provisions of Decree No. 281/2026/ND-CP is that where a husband and wife jointly hold land use rights, any administrative violation arising in relation to such land shall be subject to a sanction level applicable to a single individual.
Previously, Decree No. 123/2024/ND-CP did not contain specific provisions governing this situation. The Decree only identified individuals, households, residential communities, and organizations as subjects liable for administrative sanctions, whereby households and residential communities were subject to sanctions in the same manner as individuals.
Under the new regulations, if a violation occurs on a land parcel under the joint land use rights of a husband and wife, the applicable penalty shall be determined as if it were imposed on one individual. However, depending on the nature and severity of the violation, the violator may still be required to implement remedial measures, including carrying out land registration procedures as prescribed, restoring the land to its original condition, returning any unlawful gains obtained, or taking other remedial measures in accordance with the law.
Second, Additional remedial measures for the use of forged or altered land-related documents
Article 2 of Decree No. 281/2026/ND-CP introduces additional remedial measures applicable to violations involving the use of land-related documents that have been erased, altered, amended, or forged.
Specifically, violators may be subject to one or more of the following remedial measures:
Compulsory restoration of the land to its original condition prior to the commission of the violation.
Compulsory restoration of the original status of administrative boundary markers.
Compulsory re-completion of land-related administrative procedures in accordance with applicable regulations.
Compulsory submission of documents that have been erased, altered, falsified in content, or forged documents that have been used.
Notably, instead of applying the additional sanction of confiscation of forged or altered documents as previously prescribed, Decree No. 281/2026/ND-CP abolishes this sanction and replaces it with a remedial measure requiring violators to surrender the infringing documents. This amendment contributes to improving the legal framework for handling fraudulent acts committed during the implementation of land-related administrative procedures.
Third, Expanded sanctioning authority of Chairpersons of Commune-level People’s Committees
From 31 August 2026, the authority of Chairpersons of Commune-level People’s Committees to impose administrative sanctions in the land sector is significantly expanded.
Under the new regulations, the maximum monetary fine falling within the sanctioning authority of Chairpersons of Commune-level People’s Committees increases from VND 5 million to VND 250 million, representing a fifty-fold increase compared to the previous limit.
In addition to the authority to impose monetary fines, Chairpersons of Commune-level People’s Committees are also entitled to apply other forms of handling measures, including:
Issuing warnings.
Suspending consultancy service activities for a maximum period of three months.
Applying remedial measures in accordance with the laws on administrative sanctions for violations in the land sector.
Fourth, Failure to register land changes may result in a fine of up to VND 3 million
Pursuant to Clause 2, Article 16 of Decree No. 123/2024/ND-CP, as amended and supplemented by Decree No. 281/2026/ND-CP, from 31 August 2026, individuals who fail to register land changes in cases required by law may be subject to an administrative fine ranging from VND 2 million to VND 3 million.
This sanction applies to cases of failure to register land changes as prescribed under Points a, b, i, k, l, m, and q, Clause 1, Article 133 of the Land Law, except for cases where land use rights are acquired for the implementation of an investment project through an agreement on the receipt of land use rights in accordance with Article 127 of the Land Law.
The supplementation and amendment of these provisions aim to enhance the effectiveness of State management over land, strengthen the deterrent effect against violations, and contribute to ensuring that land is managed and used in compliance with applicable legal regulations.
2.2. Legal Regulations on Judicial and Court Matters
From August 2026, several new legal regulations officially take effect, notably the new court rules of procedure and the Ordinance on the procedures for the Court to consider and decide the compulsory rehabilitation of persons aged from 12 to under 18 years old. These regulations contribute to strengthening discipline during court proceedings and improving the legal framework for handling cases involving juvenile drug users.
First, Issuance of new court rules of procedure
Under Circular No. 12/2026/TT-TANDTC, the court rules of procedure introduce several new provisions aimed at ensuring order, security, and the strictness of judicial proceedings.
Key provisions include:
Mobile phones, tablets, or other devices capable of recording images must not be brought into the courtroom without prior permission from a competent authority.
Specific regulations on audio and video recording during court proceedings.
Additional provisions on the responsibilities of participants in legal proceedings regarding compliance with court rules and maintaining order during hearings.
These new regulations are expected to contribute to improving professionalism, openness, and transparency in the adjudication activities of the Courts.
Second, Application of the new Ordinance on compulsory rehabilitation for persons aged from 12 to under 18 years old
From 1 August 2026, Ordinance No. 03/2026/UBTVQH16 on the procedures for the People’s Court to consider and decide the compulsory rehabilitation of drug-addicted persons aged from 12 to under 18 years old officially takes effect.
The Ordinance consists of five chapters and 48 articles, replacing Ordinance No. 01/2022/UBTVQH15 and ensuring consistency with the 2025 Law on Prevention and Control of Narcotic Substances.
Under the new regulations, the People’s Court shall consider and decide the application of the measure of sending drug-addicted persons aged from 12 to under 18 years old to compulsory rehabilitation at reform schools in accordance with specific procedures prescribed by law.
In addition, the Ordinance introduces provisions on the postponement, exemption, and temporary suspension of enforcement of decisions on compulsory rehabilitation, in accordance with the new provisions of the 2025 Law on Prevention and Control of Narcotic Substances. These provisions contribute to improving the legal framework while providing better protection for the legitimate rights and interests of minors during the application of administrative handling measures.
2.3. Legal Regulations on Investment, Enterprises, and Bidding
From August 2026, several new legal regulations in the fields of bidding, investment, securities, and banking officially take effect. Notably, investors applying high technology and environmentally friendly technologies will be entitled to preferential treatment during the bidding process under the new regulations.
First, Investors applying high technology are entitled to a 5% preference in bid dossier evaluation
Under Decree No. 274/2026/ND-CP guiding the implementation of the Law on Bidding regarding investor selection, certain eligible entities shall receive preferential treatment during the evaluation of bid dossiers.
Specifically, investors that apply solutions involving advanced technologies, high technologies, environmentally friendly technologies, or the best available techniques to minimize environmental pollution for projects classified as having a high risk of adverse environmental impacts in accordance with environmental protection laws shall receive a 5% preferential margin during the evaluation of bid dossiers.
This regulation aims to encourage enterprises to invest in modern technologies, promote sustainable development, and improve environmental protection effectiveness in investment projects.
Second, Various new legal documents in the fields of investment and finance take effect
In addition to Decree No. 274/2026/ND-CP, several important legal documents in the fields of investment, finance, and related sectors also begin to apply from August 2026, including:
Decree No. 274/2026/ND-CP guiding the implementation of the Law on Bidding regarding investor selection.
Regulations providing preferential treatment for investors applying high technology, green technology, and environmentally friendly technologies during the evaluation of bid dossiers.
Circular No. 80/2026/TT-BTC amending and supplementing regulations on the registration of public companies.
Circular No. 32/2026/TT-NHNN providing regulations on lending activities for overseas investment purposes.
The issuance and implementation of these legal documents contribute to improving the legal framework governing bidding, investment, finance, and banking activities. At the same time, they create favorable conditions for enterprises to innovate technologies, enhance competitiveness, and promote sustainable economic development.
