1. Người Việt Nam ở nước ngoài được hiểu như thế nào?

Căn cứ khoản 3 Điều 3 Nghị định 138/2006/NĐ-CP quy định như sau: ““Người Việt Nam định cư ở nước ngoài” là người có quốc tịch Việt Nam và người gốc Việt Nam đang cư trú, làm ăn, sinh sống lâu dài ở nước ngoài.”

Theo quy định này, người Việt Nam định cư ở nước ngoài bao gồm hai nhóm:

– Người vẫn còn quốc tịch Việt Nam nhưng đang cư trú, sinh sống lâu dài ở nước ngoài;

– Người gốc Việt Nam đã mang quốc tịch nước ngoài hoặc không còn quốc tịch Việt Nam nhưng có nguồn gốc Việt Nam.

2. Người Việt Nam ở nước ngoài có được hưởng di sản là nhà ở không?

Căn cứ Điều 8 Luật Nhà ở 2024 có quy định về đối tượng, điều kiện được sở hữu nhà ở tại Việt Nam như sau:

Điều 8. Đối tượng và điều kiện được sở hữu nhà ở tại Việt Nam
1. Đối tượng được sở hữu nhà ở tại Việt Nam bao gồm:
a) Tổ chức, cá nhân trong nước;
b) Người Việt Nam định cư ở nước ngoài theo quy định của pháp luật về quốc tịch;
c) Tổ chức, cá nhân nước ngoài theo quy định tại khoản 1 Điều 17 của Luật này.
2. Điều kiện được sở hữu nhà ở tại Việt Nam bao gồm:
a) Tổ chức, cá nhân trong nước được sở hữu nhà ở thông qua hình thức đầu tư xây dựng, mua, thuê mua, nhận tặng cho, nhận thừa kế, nhận góp vốn, nhận đổi nhà ở; nhận nhà ở phục vụ tái định cư theo quy định của pháp luật; hình thức khác theo quy định của pháp luật;
b) Người Việt Nam định cư ở nước ngoài được phép nhập cảnh vào Việt Nam được sở hữu nhà ở gắn với quyền sử dụng đất ở theo quy định của pháp luật về đất đai;
c) Tổ chức, cá nhân nước ngoài được sở hữu nhà ở thông qua các hình thức quy định tại khoản 2 Điều 17 của Luật này.
3. Chính phủ quy định cụ thể giấy tờ chứng minh về đối tượng và điều kiện được sở hữu nhà ở quy định tại Điều này.”

Như vậy, có thể khẳng định rằng người Việt Nam ở nước ngoài hoàn toàn có quyền hưởng di sản là nhà ở tại Việt Nam nếu thuộc diện được hưởng thừa kế theo di chúc hoặc theo pháp luật.

Ví dụ: Cha mẹ tại Việt Nam để lại căn nhà cho con đang định cư tại nước ngoài, thì người con này vẫn có quyền nhận phần di sản đó.

Tuy nhiên, không phải cứ thuộc nhóm đối tượng này thì đương nhiên được đứng tên sở hữu nhà ở. Pháp luật cho phép người Việt Nam ở nước ngoài được nhận thừa kế nhà đất, nhưng để được công nhận quyền sở hữu và thực hiện thủ tục sang tên trên Giấy chứng nhận thì người nhận thừa kế phải đáp ứng điều kiện theo quy định của pháp luật, đặc biệt là điều kiện được phép nhập cảnh vào Việt Nam.

Cụ thể, đối với người Việt Nam định cư ở nước ngoài: phải được phép nhập cảnh vào Việt Nam thì mới được công nhận quyền sở hữu nhà ở gắn liền với quyền sử dụng đất ở theo quy định của pháp luật đất đai.

3. Hồ sơ chứng minh cá nhân được sở hữu nhà ở đối với người Việt Nam định cư ở nước ngoài

Căn cứ khoản 2, khoản 3 Điều 3 Nghị định 95/2024/NĐ-CP, người Việt Nam định cư ở nước ngoài muốn được công nhận quyền sở hữu nhà ở tại Việt Nam cần có giấy tờ chứng minh thuộc đối tượng được sở hữu nhà ở và giấy tờ chứng minh đáp ứng điều kiện sở hữu nhà ở theo quy định pháp luật.

Cụ thể, đối với người gốc Việt Nam định cư ở nước ngoài:

– Phải có hộ chiếu nước ngoài hoặc giấy tờ đi lại quốc tế hợp lệ theo quy định về xuất nhập cảnh;

– Đồng thời phải có giấy tờ xác nhận là người gốc Việt Nam theo quy định của pháp luật về quốc tịch.

Ngoài giấy tờ chứng minh thuộc đối tượng được sở hữu nhà ở, pháp luật còn yêu cầu giấy tờ chứng minh đủ điều kiện sở hữu nhà ở tại Việt Nam.

Theo đó:

Đối với người Việt Nam định cư ở nước ngoài là công dân Việt Nam:

– Phải có hộ chiếu Việt Nam còn giá trị sử dụng;

– Có đóng dấu nhập cảnh vào Việt Nam tại thời điểm xác lập quyền sở hữu nhà ở.

Đối với người gốc Việt Nam định cư ở nước ngoài:

– Phải có hộ chiếu còn giá trị hoặc giấy tờ đi lại quốc tế hợp lệ;

– Có đóng dấu kiểm chứng nhập cảnh vào Việt Nam tại thời điểm ký kết giao dịch về nhà ở.

Như vậy, người Việt Nam định cư ở nước ngoài vẫn có thể được sở hữu nhà ở tại Việt Nam, kể cả trong trường hợp nhận thừa kế nhà đất. Tuy nhiên, để được đứng tên hợp pháp trên giấy chứng nhận, người nhận nhà cần chuẩn bị đầy đủ giấy tờ chứng minh quốc tịch Việt Nam và điều kiện nhập cảnh theo đúng quy định của pháp luật.

4. Hồ sơ chứng minh quốc tịch Việt Nam

Theo Điều 11 Luật Quốc tịch Việt Nam, một trong các giấy tờ sau đây có giá trị chứng minh người có quốc tịch Việt Nam:

Điều 11. Giấy tờ chứng minh quốc tịch Việt Nam
Một trong các giấy tờ sau đây có giá trị chứng minh người có quốc tịch Việt Nam:
1. Giấy khai sinh; trường hợp Giấy khai sinh không thể hiện rõ quốc tịch Việt Nam thì phải kèm theo giấy tờ chứng minh quốc tịch Việt Nam của cha mẹ;
2. Giấy chứng minh nhân dân; thẻ Căn cước công dân; thẻ căn cước; căn cước điện tử;
3. Hộ chiếu Việt Nam;
4. Quyết định cho nhập quốc tịch Việt Nam, Quyết định cho trở lại quốc tịch Việt Nam, Quyết định công nhận việc nuôi con nuôi đối với trẻ em là người nước ngoài, Quyết định cho người nước ngoài nhận trẻ em Việt Nam làm con nuôi.
5. Các giấy tờ khác do Chính phủ quy định.”

Trong thực tế, hộ chiếu Việt Nam còn giá trị sử dụng là giấy tờ phổ biến nhất để chứng minh quốc tịch Việt Nam đối với người đang sinh sống ở nước ngoài. Ngoài ra, một số trường hợp đã thôi quốc tịch Việt Nam nhưng vẫn là người gốc Việt Nam thì cần thực hiện thủ tục xác nhận nguồn gốc Việt Nam để đủ điều kiện sở hữu nhà ở tại Việt Nam.

5. Trường hợp không đủ điều kiện sở hữu nhà ở thì giải quyết thế nào?

Không phải mọi trường hợp người Việt Nam ở nước ngoài nhận thừa kế nhà đất đều được đứng tên sở hữu nhà ở tại Việt Nam. Trong trường hợp không đáp ứng điều kiện theo quy định của pháp luật, chẳng hạn như:

– Không được phép nhập cảnh vào Việt Nam;

– Không có giấy tờ chứng minh quốc tịch Việt Nam hoặc nguồn gốc Việt Nam;

– Không đủ điều kiện thuộc đối tượng được sở hữu nhà ở tại Việt Nam;

thì người nhận thừa kế sẽ không được công nhận quyền sở hữu nhà ở và không thể thực hiện thủ tục sang tên trên Giấy chứng nhận.

Tuy nhiên, dù không đủ điều kiện để trực tiếp đứng tên nhà ở, người nhận thừa kế vẫn có quyền đối với phần giá trị của căn nhà hoặc quyền sử dụng đất mà mình được hưởng theo di chúc hoặc theo pháp luật. Trong trường hợp này, người thừa kế có thể:

– Chuyển nhượng phần nhà đất được thừa kế cho cá nhân, tổ chức thuộc diện được sở hữu nhà ở tại Việt Nam;

– Tặng cho phần tài sản thừa kế cho người đủ điều kiện sở hữu;

– Thỏa thuận với các đồng thừa kế khác về việc phân chia giá trị tài sản.

Sau khi chuyển nhượng hoặc xử lý tài sản theo quy định, người thừa kế sẽ nhận lại giá trị tương ứng với phần di sản mà mình được hưởng.

1. Can Overseas Vietnamese Inherit Residential Houses in Vietnam?

With the increasing number of Vietnamese citizens living, studying, and working abroad, legal issues relating to inheritance of property in Vietnam, especially houses and residential land use rights, have become a matter of significant concern. In practice, many Vietnamese families leave houses or land in Vietnam to their children or relatives residing overseas. However, disputes and legal obstacles often arise when carrying out inheritance procedures or registering ownership of inherited property.

One of the most frequently asked questions is whether Overseas Vietnamese are legally entitled to inherit residential houses in Vietnam. In addition, many people are concerned about the legal conditions required to register ownership, the necessary documents proving eligibility, and the solutions available in cases where the heir does not satisfy the conditions for owning a house in Vietnam.

Under current Vietnamese law, Overseas Vietnamese are generally permitted to inherit residential houses in Vietnam. Nevertheless, the right to inherit property does not automatically mean the heir may immediately register ownership of the property. To be officially recognized as the lawful owner of the inherited house and residential land, the heir must satisfy several legal conditions prescribed by the laws on housing, land, nationality, and immigration.

2. How Are Overseas Vietnamese Defined?

Pursuant to Clause 3, Article 3 of Decree No. 138/2006/ND-CP:

“Overseas Vietnamese” means Vietnamese citizens and persons of Vietnamese origin who reside, conduct business, and live permanently abroad.

Accordingly, Overseas Vietnamese include two major groups:

  • Individuals who still hold Vietnamese nationality but reside and live permanently overseas;
  • Individuals of Vietnamese origin who have acquired foreign nationality or no longer possess Vietnamese nationality but still have Vietnamese roots.

This distinction is legally important because it directly affects the determination of whether an individual is eligible to own residential property in Vietnam.

In reality, many people mistakenly believe that any person of Vietnamese origin living abroad automatically has the right to own houses and land in Vietnam. However, Vietnamese law does not provide unconditional ownership rights. Instead, the law requires individuals to meet specific legal conditions, particularly conditions relating to immigration status and proof of Vietnamese nationality or Vietnamese origin.

Therefore, when an Overseas Vietnamese inherits property in Vietnam, the competent authorities will examine not only the inheritance relationship but also the legal eligibility of the heir to own residential property under Vietnamese law.

3. Are Overseas Vietnamese Entitled to Inherit Residential Houses in Vietnam?

Article 8 of the 2024 Housing Law stipulates the entities and conditions eligible for home ownership in Vietnam.

“Article 8. Subjects and Conditions Eligible for Home Ownership in Vietnam
1. Subjects eligible for home ownership in Vietnam include:
a) Domestic organizations and individuals;
b) Overseas Vietnamese in accordance with the laws on nationality;
c) Foreign organizations and individuals as prescribed in Clause 1, Article 17 of this Law.
2. Conditions for home ownership in Vietnam include:
a) Domestic organizations and individuals may own houses through forms such as investment in housing construction, purchase, lease-purchase, receipt by donation, inheritance, capital contribution, house exchange, receipt of houses for resettlement in accordance with the law, and other forms as prescribed by law;
b) Overseas Vietnamese who are permitted to enter Vietnam may own houses associated with residential land use rights in accordance with the land laws;
c) Foreign organizations and individuals may own houses through the forms prescribed in Clause 2, Article 17 of this Law.
3. The Government shall provide detailed regulations on documents proving the eligibility and conditions for home ownership as prescribed in this Article.”

Therefore, it can be affirmed that Overseas Vietnamese are legally entitled to inherit residential houses in Vietnam if they are heirs under a will or under the law.

For example, if parents in Vietnam leave a house to their child who permanently resides overseas, that child still has the legal right to receive the inherited property.

However, it is important to distinguish between the right to inherit property and the right to register ownership of the property.

Vietnamese law permits Overseas Vietnamese to inherit houses and land, but the heir must satisfy additional legal conditions before being recognized as the lawful owner and before completing procedures to register ownership on the Certificate of Land Use Rights and Ownership of Houses and Other Assets Attached to Land.

In particular, Overseas Vietnamese must generally be permitted to enter Vietnam in order to be recognized as lawful owners of houses associated with residential land use rights.

As a result, merely being an Overseas Vietnamese does not automatically guarantee the right to stand in the name of the property owner on the ownership certificate. The heir must still satisfy all legal conditions prescribed by Vietnamese law.

4. Documents Proving Eligibility for Home Ownership for Overseas Vietnamese

Pursuant to Clauses 2 and 3, Article 3 of Decree No. 95/2024/ND-CP, Overseas Vietnamese wishing to be recognized as lawful owners of houses in Vietnam must provide documents proving both:

  • Their eligibility as subjects entitled to own houses in Vietnam; and
  • Their satisfaction of the legal conditions for home ownership.

For Persons of Vietnamese Origin Residing Overseas

Individuals of Vietnamese origin residing overseas must provide:

  • A valid foreign passport or valid international travel document in accordance with immigration laws;
  • Documents proving their Vietnamese origin in accordance with nationality laws.

These documents are used by competent authorities to determine whether the individual belongs to the category of persons eligible to own houses in Vietnam.

Documents Proving Satisfaction of Home Ownership Conditions

In addition to documents proving eligibility as a subject entitled to own property, the law also requires documents proving satisfaction of home ownership conditions.

For Overseas Vietnamese Who Are Vietnamese Citizens

The following documents are required:

  • A valid Vietnamese passport;
  • An immigration stamp confirming lawful entry into Vietnam at the time ownership rights are established.

For Persons of Vietnamese Origin Residing Overseas

The following documents are required:

  • A valid passport or valid international travel document;
  • An immigration verification stamp confirming lawful entry into Vietnam at the time of signing the housing transaction or carrying out inheritance procedures.

Therefore, Overseas Vietnamese may still own residential houses in Vietnam, including houses inherited from family members. Nevertheless, to lawfully register ownership of the property, the heir must prepare all required documents proving Vietnamese nationality, Vietnamese origin, and lawful entry into Vietnam in accordance with legal regulations.

In practice, many inheritance cases encounter difficulties because the heirs cannot provide sufficient documents proving Vietnamese origin or lawful immigration status. Consequently, careful preparation of legal documents is extremely important before carrying out inheritance procedures.

4. Documents Proving Vietnamese Nationality

According to Article 11 of the Law on Vietnamese Nationality, one of the following documents may serve as proof of Vietnamese nationality:

Article 11. Documents Proving Vietnamese NationalityAny one of the following documents shall serve as proof that a person possesses Vietnamese nationality:
1. A birth certificate; where the birth certificate does not clearly indicate Vietnamese nationality, it must be accompanied by documents proving the Vietnamese nationality of the person’s parents;
2. Identity card; Citizen Identity Card; identification card; electronic identification card;
3. Vietnamese passport;
4. Decision on naturalization as a Vietnamese citizen; Decision on restoration of Vietnamese nationality; Decision recognizing the adoption of foreign children; Decision permitting foreign nationals to adopt Vietnamese children;
5. Other documents as prescribed by the Government.”

In practice, a valid Vietnamese passport is the most common and convenient document used by Overseas Vietnamese to prove Vietnamese nationality.

In some cases, individuals may have renounced Vietnamese nationality but still retain Vietnamese origin. Such individuals may need to carry out procedures for certification of Vietnamese origin in order to satisfy the conditions for owning residential property in Vietnam.

This issue is particularly important because competent authorities may refuse to recognize ownership rights if the heir cannot provide sufficient documents proving Vietnamese nationality or Vietnamese origin.

5. How Are Cases Handled Where the Heir Does Not Satisfy the Conditions for Home Ownership?

Not all Overseas Vietnamese inheriting houses or land in Vietnam are automatically entitled to register ownership of the inherited property.

If the heir fails to satisfy the legal conditions prescribed by Vietnamese law, such as:

  • Not being permitted to enter Vietnam;
  • Failing to provide documents proving Vietnamese nationality or Vietnamese origin;
  • Not belonging to the category of persons eligible to own houses in Vietnam;

then the heir will not be recognized as the lawful owner of the house and will not be able to complete ownership registration procedures.

However, failure to satisfy ownership conditions does not mean the heir loses all rights relating to the inherited property.

Under Vietnamese law, even if the heir is not eligible to directly own the house, they are still entitled to the value of the inherited property under the will or under inheritance laws.

In such cases, the heir may choose one of several lawful solutions, including:

  • Transferring the inherited house or land to an individual or organization eligible to own houses in Vietnam;
  • Donating the inherited property to a person who satisfies ownership conditions;
  • Reaching an agreement with co-heirs regarding the distribution of the property value.

After the transfer or settlement of the property in accordance with legal regulations, the heir will receive the corresponding value of the inherited portion to which they are legally entitled.

Therefore, Vietnamese law still protects the inheritance rights of Overseas Vietnamese, even where they cannot directly register ownership of inherited residential property. Nonetheless, in order to lawfully own and register inherited houses in Vietnam, Overseas Vietnamese should carefully prepare all required documents proving nationality, Vietnamese origin, immigration eligibility, and compliance with Vietnamese housing and land laws.

In complicated cases involving inheritance disputes, unclear nationality status, missing documents, or multiple heirs residing in different countries, individuals are advised to consult legal professionals to ensure that inheritance procedures are carried out properly and in compliance with Vietnamese law.
