Trong thực tế, nhiều người cho rằng chỉ cần di chúc được công chứng thì gần như chắc chắn sẽ có hiệu lực pháp luật và không thể bị tranh chấp. Tuy nhiên, công chứng không đồng nghĩa với việc di chúc mặc nhiên hợp pháp trong mọi trường hợp.

Nếu di chúc vi phạm các điều kiện theo quy định của Bộ luật Dân sự 2015 thì dù đã được công chứng, Tòa án vẫn có thể tuyên vô hiệu toàn bộ hoặc một phần khi phát sinh tranh chấp thừa kế.

Căn cứ khoản 1 Điều 630 Bộ luật Dân sự 2015 quy định:

Điều 630. Di chúc hợp pháp
1. Di chúc hợp pháp phải có đủ các điều kiện sau đây:
a) Người lập di chúc minh mẫn, sáng suốt trong khi lập di chúc; không bị lừa dối, đe doạ, cưỡng ép;
b) Nội dung của di chúc không vi phạm điều cấm của luật, không trái đạo đức xã hội; hình thức di chúc không trái quy định của luật.”

Theo đó, những trường hợp phổ biến mà di chúc đã công chứng vẫn có thể bị Tòa án tuyên vô hiệu.

(1) Người lập di chúc không minh mẫn, sáng suốt khi lập di chúc

Điều kiện đầu tiên để di chúc hợp pháp là người lập di chúc phải minh mẫn, nhận thức được hành vi của mình và tự mình làm chủ ý chí tại thời điểm lập di chúc.

Do đó, nếu tại thời điểm lập di chúc, người để lại di sản đang trong tình trạng: bệnh nặng kéo dài; mất khả năng nhận thức; bị ảnh hưởng tâm thần; không còn tỉnh táo; không kiểm soát được hành vi….. thì di chúc vẫn có thể bị yêu cầu tuyên vô hiệu dù đã được công chứng.

Trên thực tế, có nhiều trường hợp người cao tuổi đang điều trị bệnh, nằm viện hoặc sức khỏe suy giảm nghiêm trọng nhưng vẫn được đưa đi lập di chúc tại văn phòng công chứng. Khi xảy ra tranh chấp, Tòa án không chỉ căn cứ vào việc “đã công chứng” mà còn xem xét toàn bộ chứng cứ khác như: hồ sơ bệnh án; kết luận giám định; lời khai của người làm chứng; tình trạng sức khỏe thực tế tại thời điểm lập di chúc…..

Nếu xác định người lập di chúc không còn minh mẫn, Tòa án vẫn có thể tuyên di chúc vô hiệu theo quy định pháp luật.

(2) Người lập di chúc bị lừa dối, đe dọa hoặc cưỡng ép

Di chúc chỉ được xem là hợp pháp khi thể hiện đúng ý chí tự nguyện của người để lại tài sản. Vì vậy, nếu việc lập di chúc xuất phát từ sự ép buộc hoặc bị tác động trái ý chí thì di chúc đó vẫn có thể bị vô hiệu.

Một số trường hợp thường phát sinh tranh chấp gồm: ép người lớn tuổi ký vào di chúc; gây áp lực tinh thần; cô lập người để lại di sản khỏi các thành viên khác trong gia đình; dẫn dắt hoặc áp đặt nội dung di chúc theo ý của một người nhất định…..

Ví dụ, một người con trực tiếp chăm sóc cha mẹ nhưng đồng thời kiểm soát và gây áp lực để cha mẹ sửa di chúc theo hướng chỉ để lại toàn bộ tài sản cho mình. Trong trường hợp có căn cứ chứng minh việc cưỡng ép hoặc lừa dối, Tòa án vẫn có thể tuyên vô hiệu di chúc dù văn bản đã được công chứng.

(3) Nội dung di chúc vi phạm pháp luật hoặc trái đạo đức xã hội

Ngoài điều kiện về ý chí, nội dung của di chúc cũng phải phù hợp quy định pháp luật và không trái đạo đức xã hội.

Một số trường hợp có thể dẫn đến việc di chúc bị vô hiệu gồm: định đoạt tài sản không thuộc quyền sở hữu của người lập di chúc; để lại tài sản nhằm thực hiện hành vi trái pháp luật; tước quyền hưởng di sản trái quy định; nội dung vi phạm đạo đức xã hội hoặc trái quy định pháp luật…..

Ví dụ, người lập di chúc tự ý định đoạt toàn bộ tài sản là tài sản chung của vợ chồng mà không thuộc toàn bộ quyền sở hữu của mình. Khi tranh chấp xảy ra, phần di chúc liên quan đến phần tài sản không thuộc quyền sở hữu có thể bị tuyên vô hiệu.

Ngoài ra, việc di chúc đã được công chứng cũng không đồng nghĩa công chứng viên đã xác minh đầy đủ toàn bộ nguồn gốc tài sản hoặc các tranh chấp liên quan trên thực tế. Vì vậy, nếu phát hiện nội dung di chúc vi phạm quy định pháp luật thì Tòa án vẫn có quyền xem xét tuyên vô hiệu.

Lưu ý: Công chứng viên không phải lúc nào cũng có điều kiện xác minh toàn bộ nguồn gốc tài sản hoặc quan hệ thực tế phát sinh tranh chấp.

(4) Hình thức di chúc không đúng quy định

Bên cạnh nội dung và ý chí, hình thức của di chúc cũng là điều kiện bắt buộc để di chúc hợp pháp. Nếu không tuân thủ đúng quy định về hình thức thì di chúc vẫn có thể bị vô hiệu dù đã được công chứng.

Một số trường hợp thường gặp gồm: không đúng thủ tục ký tên hoặc điểm chỉ; người không biết chữ nhưng không có người làm chứng hợp lệ; việc lập di chúc không đúng trình tự theo quy định pháp luật…..

Ngoài các điều kiện về chủ thể, ý chí, nội dung và hình thức theo Điều 630 Bộ luật Dân sự 2015, trên thực tế, mặc dù di chúc được công chứng nhưng vẫn có thể bị tuyên vô hiệu nếu vi phạm các quy định pháp luật có liên quan trong quá trình lập di chúc và xác lập hiệu lực di chúc.

Cụ thể:

(1) Di chúc bị tuyên vô hiệu khi người làm chứng cho việc lập di chúc không đủ điều kiện theo quy định pháp luật. 

Điều 632. Người làm chứng cho việc lập di chúc
Mọi người đều có thể làm chứng cho việc lập di chúc, trừ những người sau đây:
1. Người thừa kế theo di chúc hoặc theo pháp luật của người lập di chúc.
2. Người có quyền, nghĩa vụ tài sản liên quan tới nội dung di chúc.
3. Người chưa thành niên, người mất năng lực hành vi dân sự, người có khó khăn trong nhận thức, làm chủ hành vi.”

Pháp luật quy định người làm chứng phải là người khách quan, không có quyền lợi liên quan trực tiếp đến nội dung di chúc nhằm bảo đảm tính trung thực và tự nguyện của việc lập di chúc.

Do đó, những người sau đây sẽ không được làm chứng cho việc lập di chúc:

– Người thừa kế theo di chúc hoặc theo pháp luật;

– Người có quyền, nghĩa vụ tài sản liên quan đến nội dung di chúc;

– Người chưa thành niên;

– Người mất năng lực hành vi dân sự;

– Người có khó khăn trong nhận thức, làm chủ hành vi.

Trên thực tế, có nhiều trường hợp người thân trong gia đình vừa là người được hưởng di sản vừa trực tiếp đứng ra làm chứng cho việc lập di chúc. Khi xảy ra tranh chấp, đây có thể trở thành căn cứ để yêu cầu Tòa án xem xét tính hợp pháp của di chúc.

Do đó, nếu việc vi phạm quy định về người làm chứng làm ảnh hưởng đến tính khách quan hoặc tính hợp pháp của việc lập di chúc, thì dù di chúc đã được công chứng, Tòa án vẫn có thể xem xét tuyên vô hiệu toàn bộ hoặc một phần di chúc theo quy định pháp luật.

(2) Di chúc không có hiệu lực theo Điều 643 Bộ luật Dân sự 2015

Lưu ý: Công chứng chỉ là một yếu tố nhằm tăng giá trị chứng cứ của di chúc, chứ không thay thế toàn bộ các điều kiện hợp pháp khác theo quy định của Bộ luật Dân sự. Vì vậy, nếu không đáp ứng đầy đủ các điều kiện theo quy định của pháp luật thì vẫn có thể bị tòa án tuyên vô hiệu (tùy vào mức độ sai mà bị tuyên vô hiệu từng phần hoặc vô hiệu toàn bộ).

Để hạn chế tối đa rủi ro di chúc được công chứng nhưng lại bị tòa án tuyên vô hiệu, người lập di chúc nên chủ động tìm hiểu kỹ các quy định pháp luật liên quan trước khi thực hiện. Trường hợp không có điều kiện hoặc không đủ khả năng tự nghiên cứu, có thể nhờ luật sư hoặc chuyên gia pháp lý có kinh nghiệm trong lĩnh vực này tư vấn, nhằm bảo đảm di chúc được lập đúng quy định và thể hiện đúng ý chí của mình.

In practice, many people believe that once a will has been notarized, it is almost certainly legally valid and cannot be challenged. However, notarization does not automatically mean that a will is lawful in every circumstance.

If a will violates the conditions prescribed by the 2015 Civil Code of Vietnam, the Court may still declare the will wholly or partially invalid despite the fact that it has already been notarized, especially when inheritance disputes arise.

Pursuant to Clause 1, Article 630 of the 2015 Civil Code:

Article 630. Lawful wills

1. A lawful will must satisfy all of the following conditions:

a) The testator is of sound mind while making the will; he or she is not deceived, threatened, or coerced;

b) The contents of the will do not violate prohibitions of the law or social ethics; and the form of the will complies with legal provisions.”

Accordingly, there are several common situations in which a notarized will may still be declared invalid by the Court.

(1) The testator was not mentally sound or fully aware when making the will

The first requirement for a lawful will is that the testator must be mentally competent, fully aware of his or her actions, and capable of independently expressing his or her intentions at the time the will is made.

Therefore, if at the time of making the will, the deceased person was suffering from conditions such as prolonged serious illness, loss of awareness, mental impairment, unconsciousness, or inability to control his or her behavior, the will may still be challenged and declared invalid even if it was notarized.

In reality, there are many cases where elderly individuals undergoing medical treatment, hospitalized patients, or persons whose health had seriously deteriorated were still taken to a notary office to execute a will. When disputes arise, the Court does not rely solely on the fact that the will was notarized, but also examines other evidence such as medical records, expert assessment conclusions, witness testimonies, and the actual health condition of the testator at the time the will was made.

If the Court determines that the testator was no longer mentally competent, the will may still be declared invalid in accordance with the law.

(2) The testator was deceived, threatened, or coerced

A will is only considered lawful when it accurately reflects the voluntary intentions of the person leaving the estate. Therefore, if the will was created under pressure, coercion, or unlawful influence, it may still be invalidated.

Common situations leading to disputes include forcing elderly persons to sign a will, exerting psychological pressure, isolating the deceased from other family members, or directing and imposing the contents of the will according to the wishes of a particular individual.

For example, a child who directly cares for elderly parents may simultaneously control and pressure them into revising the will so that all property is left solely to that child. If there is sufficient evidence proving coercion or deception, the Court may still invalidate the will despite its notarization.

(3) The contents of the will violate the law or social ethics

In addition to the requirement regarding the testator’s intent, the contents of the will must also comply with legal regulations and social ethics.

Several circumstances that may lead to invalidation include: disposition of property not owned by the testator; leaving property for unlawful purposes; unlawfully depriving someone of inheritance rights; or including contents contrary to social morality or legal provisions.

For instance, a testator may attempt to dispose of all property that is in fact jointly owned by husband and wife, even though only part of that property legally belongs to the testator. In the event of a dispute, the portion of the will concerning property beyond the testator’s ownership rights may be declared invalid.

Furthermore, the fact that a will has been notarized does not necessarily mean that the notary fully verified the origin of all assets or all actual disputes relating to the property. Therefore, if the contents of the will are later found to violate the law, the Court still has the authority to declare the will invalid.

Note: A notary public does not always have sufficient conditions to comprehensively verify the origin of all assets or factual relationships giving rise to disputes.

(4) The form of the will does not comply with legal requirements

Besides the contents and intentions of the testator, the form of the will is also a mandatory condition for validity. Failure to comply with formal legal requirements may result in the will being declared invalid even if it has been notarized.

Common examples include failure to properly sign or fingerprint the will, situations where an illiterate person makes a will without lawful witnesses, or cases where the process of making the will does not comply with legally prescribed procedures.

In addition to the conditions relating to the testator, intention, contents, and form under Article 630 of the 2015 Civil Code, in practice, a notarized will may still be invalidated if there are violations of other relevant legal provisions during the process of making the will or establishing its legal effectiveness.

Specifically:

(1) A will may be declared invalid if the witnesses do not meet legal requirements

Article 632. Witnesses to the making of wills

Any person may act as a witness to the making of a will, except for the following persons:

1. Heirs under the will or at law of the testator;

2. Persons having property rights or obligations related to the contents of the will;

3. Minors, persons lacking civil act capacity, or persons having difficulties in cognition or behavioral control.”

The law requires witnesses to be objective individuals who have no direct interests relating to the contents of the will, thereby ensuring the honesty and voluntariness of the will-making process.

Accordingly, the following persons are not permitted to act as witnesses to the making of a will:

  • Heirs under the will or under the law;
  • Persons having property-related rights or obligations connected to the will;
  • Minors;
  • Persons lacking civil act capacity;
  • Persons having difficulties in cognition or behavioral control.

In practice, there are many cases where family members who are beneficiaries of the estate also directly act as witnesses to the making of the will. When disputes arise, this may become grounds for requesting the Court to review the legality of the will.

Therefore, if a violation concerning witnesses affects the objectivity or legality of the will-making process, the Court may still declare all or part of the will invalid even if the will has already been notarized.

(2) The will has no legal effect under Article 643 of the 2015 Civil Code

It should be noted that notarization is only one factor that strengthens the evidentiary value of a will; it does not replace all other legal conditions required under the Civil Code. Therefore, if the will fails to satisfy all legal requirements, the Court may still declare it partially or wholly invalid depending on the seriousness of the violation.

To minimize the risk of a notarized will later being declared invalid by the Court, a testator should proactively study the relevant legal regulations before making the will. In cases where the individual does not have sufficient conditions or expertise to conduct legal research independently, he or she may seek advice from a lawyer or legal professional experienced in inheritance matters in order to ensure that the will is prepared in accordance with the law and accurately reflects the testator’s true intentions.
