a) Đã bị xử phạt vi phạm hành chính về hành vi chiếm đoạt tài sản mà còn vi phạm;
b) Đã bị kết án về tội này hoặc về một trong các tội quy định tại các điều 168, 169, 170, 171, 172, 173, 175 và 290 của Bộ luật này, chưa được xóa án tích mà còn vi phạm;
c) Gây ảnh hưởng xấu đến an ninh, trật tự, an toàn xã hội;
a) Có tổ chức;
b) Có tính chất chuyên nghiệp;
c) Chiếm đoạt tài sản trị giá từ 50.000.000 đồng đến dưới 200.000.000 đồng;
d) Tái phạm nguy hiểm;
đ) Lợi dụng chức vụ, quyền hạn hoặc lợi dụng danh nghĩa cơ quan, tổ chức;
e) Dùng thủ đoạn xảo quyệt;
a) Chiếm đoạt tài sản trị giá từ 200.000.000 đồng đến dưới 500.000.000 đồng;
c) Lợi dụng thiên tai, dịch bệnh.
a) Chiếm đoạt tài sản trị giá 500.000.000 đồng trở lên;
c) Lợi dụng hoàn cảnh chiến tranh, tình trạng khẩn cấp.

Căn cứ điểm a khoản 5, điểm b khoản 6, điểm a khoản 10 Điều 30 Nghị định 340/2025/NĐ-CP:

“Điều 30. Vi phạm quy định về hoạt động thanh toán
….
5. Phạt tiền từ 100.000.000 đồng đến 150.000.000 đồng đối với một trong các hành vi vi phạm sau đây:
a) Mua, bán, thuê, cho thuê, mượn, cho mượn tài khoản thanh toán hoặc mua, bán thông tin tài khoản thanh toán với số lượng từ 01 tài khoản thanh toán đến dưới 10 tài khoản thanh toán mà chưa đến mức bị truy cứu trách nhiệm hình sự;
…
6. Phạt tiền từ 150.000.000 đồng đến 200.000.000 đồng đối với một trong các hành vi vi phạm sau đây:
…
b) Mua, bán, thuê, cho thuê, mượn, cho mượn tài khoản thanh toán hoặc mua, bán thông tin tài khoản thanh toán với số lượng từ 10 tài khoản thanh toán trở lên mà chưa đến mức bị truy cứu trách nhiệm hình sự;
…
10. Biện pháp khắc phục hậu quả:
a) Buộc nộp vào ngân sách nhà nước số lợi bất hợp pháp có được do thực hiện hành vi vi phạm quy định tại khoản 1, các điểm a, b khoản 4, các điểm a, b khoản 5, các điểm b, c, d, đ, e khoản 6, các điểm a, b, c, d khoản 7 và điểm b khoản 8 Điều này;
…”

The content is provided by Tuyet Nhung Bui Law Firm for reference purposes only.

Can lending a bank account to receive fraudulently obtained money result in criminal liability?

Lending a bank account to another person to receive money obtained through fraud may result in criminal liability if the conduct satisfies the elements of a criminal offense. However, when determining criminal liability, it is necessary to establish whether the account holder knew about the criminal activity and intentionally assisted the person committing the offense.

For example, did the account holder know that the account would be used to receive money obtained through fraud? Did they directly carry out withdrawal or transfer transactions, provide security information, or receive payment in exchange for lending the account?

To determine whether the account holder may be held criminally liable alongside the fraudster, Article 17 of the 2015 Criminal Code provides the following regulations on accomplices:

“Article 17. Accomplices
1. Accomplicity occurs when two or more people intentionally commit the same criminal offense.
2. Organized crime is a form of complicity in which the participants have a close-knit arrangement to commit the offense together.
3. Accomplices include organizers, perpetrators, instigators, and aiders.
The perpetrator is the person who directly commits the criminal offense.
The organizer is the person who masterminds, leads, or directs the commission of the criminal offense.
The instigator is the person who incites, entices, or encourages another person to commit the criminal offense.
The aider is the person who provides mental or material assistance for the commission of the criminal offense.
4. An accomplice is not criminally liable for acts that exceed the scope of the perpetrator’s conduct.”

Accordingly, if the account holder knows that the account is being used to receive money obtained through fraud but still intentionally lends it to facilitate another person’s appropriation of property, they may be considered an accomplice and held criminally liable.

What criminal offense may apply to lending a bank account to receive fraudulently obtained money?

Where there are grounds to establish that the account holder knew about the fraudulent purpose and intentionally facilitated the appropriation of property, they may face criminal prosecution as an accomplice to the offense of fraudulently appropriating property.

“Article 174. Fraudulently Appropriating Property
1. Any person who, by fraudulent means, appropriates another person’s property valued at VND 2,000,000 or more but less than VND 50,000,000, or valued at less than VND 2,000,000 in any of the following circumstances, shall be subject to non-custodial reform for up to 03 years or imprisonment for between 06 months and 03 years:
a) The offender has been administratively sanctioned for property appropriation but commits another violation;
b) The offender has been convicted of this offense or one of the offenses specified in Articles 168, 169, 170, 171, 172, 173, 175, and 290 of this Code, has not had the conviction expunged, and commits another violation;
c) The offense adversely affects security, public order, or social safety;
d) The property is the victim’s and their family’s primary means of livelihood.
2. If the offense falls into one of the following circumstances, the offender shall be sentenced to imprisonment for between 02 and 07 years:
a) The offense is committed by an organized group;
b) The offense is committed professionally;
c) The appropriated property is valued at VND 50,000,000 or more but less than VND 200,000,000;
d) The offender commits the offense in a dangerous state of recidivism;
đ) The offender abuses their position or authority, or the name of an agency or organization;
e) The offender uses cunning tricks;
3. If the offense falls into one of the following circumstances, the offender shall be sentenced to imprisonment for between 07 and 15 years:
a) The appropriated property is valued at VND 200,000,000 or more but less than VND 500,000,000;
c) The offender takes advantage of a natural disaster or epidemic.
4. If the offense falls into one of the following circumstances, the offender shall be sentenced to imprisonment for between 12 and 20 years or life imprisonment:
a) The appropriated property is valued at VND 500,000,000 or more;
c) The offender takes advantage of wartime conditions or a state of emergency.
5. The offender may also be subject to a fine of between VND 10,000,000 and VND 100,000,000, a prohibition from holding certain positions or practicing certain occupations or performing certain jobs for between 01 and 05 years, or confiscation of part or all of their property.”

Accordingly, if the account holder is determined to be an accomplice, they may be held criminally liable for fraudulently appropriating property. In addition to this offense, the account holder may also be investigated for other criminal offenses, depending on the nature and purpose of the actual conduct.

What are the penalties for lending a bank account to receive fraudulently obtained money when the conduct does not warrant criminal prosecution?

Where the conduct does not satisfy the elements of a criminal offense, the account holder may still be subject to administrative penalties if the conduct constitutes a violation of regulations on payment activities.

Pursuant to Point a, Clause 5; Point b, Clause 6; and Point a, Clause 10 of Article 30 of Decree No. 340/2025/ND-CP:

“Article 30. Violations of Regulations on Payment Activities
….
5. A fine of between VND 100,000,000 and VND 150,000,000 shall be imposed for any of the following violations:
a) Buying, selling, renting, leasing, borrowing, or lending payment accounts, or buying or selling payment account information, involving from 01 to fewer than 10 payment accounts, where the conduct does not warrant criminal prosecution;
…
6. A fine of between VND 150,000,000 and VND 200,000,000 shall be imposed for any of the following violations:
…
b) Buying, selling, renting, leasing, borrowing, or lending payment accounts, or buying or selling payment account information, involving 10 or more payment accounts, where the conduct does not warrant criminal prosecution;
…
10. Remedial measures:
a) Compelling the remittance to the state budget of any unlawful gains obtained from the violations specified in Clause 1; Points a and b of Clause 4; Points a and b of Clause 5; Points b, c, d, đ, and e of Clause 6; Points a, b, c, and d of Clause 7; and Point b of Clause 8 of this Article;
…”

Accordingly, a person who lends a payment account may be fined between VND 100 million and VND 200 million, depending on the number of accounts involved in the violation. In addition to the monetary fine, the violator may also be required to surrender any unlawful gains obtained from the violation.

Precautions to avoid inadvertently facilitating crimes through bank accounts

First, do not allow other people to use your bank account. Each individual should manage the account registered in their own name and should not casually lend or rent it out, or allow others to open accounts for their own purposes.

Second, proactively protect confidential information. Keep your login credentials, passwords, OTP codes, bank card information, personal identification documents, and other sensitive information strictly confidential. Do not provide such information to strangers or submit it through links from unknown sources.

Third, remain vigilant about offers to open bank accounts, receive money on behalf of others, or participate in online investments. Fraudsters may impersonate bank employees, financial institutions, or acquaintances to gain trust before asking victims to open accounts, receive money, and transfer it according to their instructions. Promises of easy money or high commissions in exchange for little work should be treated with caution.

Fourth, act promptly when suspicious activity is detected. If you have already allowed someone else to use your account or suspect that your account is being misused, contact your bank immediately to request assistance in blocking the account or temporarily suspending transactions where necessary. You should also report the matter to the police and provide relevant information and documents to assist with verification and investigation.

Fifth, regularly update your knowledge of fraud warnings and applicable laws. People should follow advisories issued by the police, banks, and other official sources to recognize emerging fraud schemes. Sharing warnings with family members can also help reduce the risk of being deceived into participating in unlawful activities.
