1. Điều kiện để người lao động nước ngoài làm việc hợp pháp tại Việt Nam là gì?
Căn cứ khoản 1 Điều 151 Bộ luật Lao động 2019, người lao động nước ngoài làm việc tại Việt Nam là người có quốc tịch nước ngoài và phải đáp ứng đầy đủ các điều kiện sau đây:
Như vậy, trước khi tuyển dụng hoặc tiếp nhận lao động nước ngoài, doanh nghiệp cần rà soát kỹ điều kiện pháp lý của người lao động để bảo đảm việc sử dụng lao động được thực hiện đúng quy định, tránh nguy cơ bị xử phạt vi phạm hành chính hoặc phát sinh các rủi ro pháp lý trong quá trình hoạt động.
2. Người nước ngoài có thể tham gia thị trường lao động Việt Nam theo những hình thức nào?
Không phải người nước ngoài nào làm việc tại Việt Nam cũng ký hợp đồng lao động với doanh nghiệp Việt Nam. Trên thực tế, pháp luật cho phép người nước ngoài tham gia thị trường lao động Việt Nam dưới nhiều hình thức khác nhau, tùy thuộc vào mục đích làm việc và mối quan hệ với doanh nghiệp, tổ chức tại Việt Nam.
Theo khoản 1 Điều 2 Nghị định 219/2025/NĐ-CP, người lao động nước ngoài có thể làm việc tại Việt Nam theo các hình thức sau:
Mỗi hình thức làm việc của người nước ngoài tại Việt Nam sẽ đi kèm những yêu cầu và thủ tục khác nhau về hồ sơ, thủ tục cấp giấy phép lao động, xác nhận miễn giấy phép lao động, thị thực, thẻ tạm trú cũng như trách nhiệm của người sử dụng lao động. Vì vậy, doanh nghiệp cần xác định đúng ngay từ đầu hình thức tham gia thị trường lao động của người nước ngoài thuộc trường hợp nào để chuẩn bị hồ sơ phù hợp, tiết kiệm thời gian và tránh phát sinh những vướng mắc trong quá trình sử dụng lao động nước ngoài.
3. Doanh nghiệp được tuyển dụng lao động nước ngoài vào những vị trí nào?
Căn cứ Điều 3 Nghị định 219/2025/NĐ-CP:
“Điều 3. Vị trí công việc của người lao động nước ngoài làm việc tại Việt Nam
1. Nhà quản lý là người quản lý doanh nghiệp theo quy định tại khoản 24 Điều 4 Luật Doanh nghiệp hoặc là người đứng đầu, cấp phó của người đứng đầu của cơ quan, tổ chức theo quy định của pháp luật.
2. Giám đốc điều hành thuộc một trong các trường hợp sau đây:
a) Người đứng đầu chi nhánh, văn phòng đại diện hoặc địa điểm kinh doanh của doanh nghiệp;
b) Người đứng đầu và trực tiếp điều hành một lĩnh vực của cơ quan, tổ chức, doanh nghiệp và có ít nhất 3 năm kinh nghiệm trong lĩnh vực phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam.
3. Chuyên gia thuộc một trong các trường hợp sau đây:
a) Có bằng đại học trở lên hoặc tương đương và có ít nhất 2 năm kinh nghiệm làm việc phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam;
b) Có bằng đại học trở lên trong chuyên ngành được đào tạo và có ít nhất 1 năm kinh nghiệm phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam đối với chuyên gia làm việc trong lĩnh vực tài chính, khoa học, công nghệ, đổi mới sáng tạo, chuyển đổi số quốc gia hoặc lĩnh vực ưu tiên phát triển kinh tế – xã hội được bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh xác định hoặc theo thỏa thuận hợp tác của Chính phủ Việt Nam.
4. Lao động kỹ thuật thuộc một trong các trường hợp sau đây:
a) Được đào tạo ít nhất 1 năm và có ít nhất 2 năm kinh nghiệm phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam;
b) Có ít nhất 3 năm kinh nghiệm làm việc phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam.”
Theo đó, người lao động nước ngoài làm việc tại Việt Nam được bố trí vào một trong bốn nhóm vị trí công việc sau đây:
(1) Nhà quản lý
Nhà quản lý là người quản lý doanh nghiệp theo quy định của Luật Doanh nghiệp hoặc là người đứng đầu, cấp phó của người đứng đầu cơ quan, tổ chức theo quy định của pháp luật.
(2) Giám đốc điều hành
Giám đốc điều hành là người thuộc một trong các trường hợp sau:
– Là người đứng đầu chi nhánh, văn phòng đại diện hoặc địa điểm kinh doanh của doanh nghiệp;
– Là người đứng đầu và trực tiếp điều hành một lĩnh vực của cơ quan, tổ chức, doanh nghiệp và có ít nhất 03 năm kinh nghiệm trong lĩnh vực phù hợp với vị trí công việc dự kiến đảm nhiệm tại Việt Nam.
Khác với nhà quản lý thường quản lý toàn bộ doanh nghiệp, giám đốc điều hành tập trung vào việc điều hành trực tiếp một đơn vị hoặc một lĩnh vực chuyên môn cụ thể.
(3) Chuyên gia
Người lao động nước ngoài được xác định là chuyên gia khi đáp ứng một trong các điều kiện sau:
* Trường hợp thứ nhất:
– Có bằng đại học trở lên hoặc tương đương; và
– Có ít nhất 02 năm kinh nghiệm làm việc phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam
* Trường hợp thứ hai:
– Có bằng đại học trở lên đúng chuyên ngành đào tạo; và
– Có ít nhất 01 năm kinh nghiệm phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam đối với chuyên gia làm việc trong lĩnh vực tài chính, khoa học, công nghệ, đổi mới sáng tạo, chuyển đổi số quốc gia hoặc lĩnh vực ưu tiên phát triển kinh tế – xã hội được bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh xác định hoặc theo thỏa thuận hợp tác của Chính phủ Việt Nam.
(4) Lao động kỹ thuật
Người lao động nước ngoài được xác định là lao động kỹ thuật nếu thuộc một trong các trường hợp sau:
* Trường hợp thứ nhất:
– Được đào tạo ít nhất 01 năm; và
– Có ít nhất 02 năm kinh nghiệm làm việc phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam;
* Trường hợp thứ hai:
– Có ít nhất 03 năm kinh nghiệm làm việc phù hợp với vị trí công việc mà người lao động nước ngoài dự kiến làm việc tại Việt Nam.
– Người lao động nước ngoài muốn làm việc hợp pháp tại Việt Nam phải đáp ứng đồng thời các điều kiện về độ tuổi, năng lực hành vi dân sự, trình độ chuyên môn, sức khỏe, nhân thân và giấy phép lao động theo quy định của Bộ luật Lao động năm 2019. Bên cạnh đó, pháp luật còn quy định nhiều hình thức tham gia thị trường lao động khác nhau cũng như bốn nhóm vị trí công việc mà người nước ngoài có thể đảm nhiệm gồm nhà quản lý, giám đốc điều hành, chuyên gia và lao động kỹ thuật.

1. What Are the Conditions for Foreign Employees to Work Legally in Vietnam?
Pursuant to Clause 1, Article 151 of the 2019 Labor Code, a foreign employee working in Vietnam is a person holding foreign nationality and must satisfy all of the following conditions:
“Article 151. Conditions for Foreign Employees Working in Vietnam
A foreign employee working in Vietnam is a person holding foreign nationality and must satisfy the following conditions:
(a) Be at least 18 years old and possess full legal civil capacity;
(b) Possess professional qualifications, technical skills, vocational skills, or work experience; and meet health requirements as prescribed by the Minister of Health;
(c) Not be serving a criminal sentence, have an unspent criminal conviction, or be subject to criminal prosecution under the laws of a foreign country or the laws of Vietnam;
(d) Hold a work permit issued by a competent Vietnamese state authority, except in cases specified in Article 154 of this Code.”
Accordingly, before recruiting or engaging a foreign employee, employers should carefully review the individual’s legal eligibility to ensure compliance with applicable regulations. This helps avoid administrative penalties and minimizes legal risks that may arise during business operations.
2. Through What Forms Can Foreigners Participate in the Vietnamese Labor Market?
Not every foreigner working in Vietnam enters into an employment contract with a Vietnamese enterprise. In practice, Vietnamese law permits foreign nationals to participate in the labor market through various forms, depending on the purpose of their work and their relationship with enterprises or organizations in Vietnam.
According to Clause 1, Article 2 of Decree No. 219/2025/ND-CP, foreign employees may work in Vietnam under the following forms:
Each form of employment or engagement in Vietnam carries different legal requirements and procedures relating to work permits, work permit exemptions, visas, temporary residence cards, and employer responsibilities. Therefore, enterprises should accurately determine from the outset the specific category under which a foreign worker participates in the Vietnamese labor market. Proper classification will facilitate preparation of the appropriate documentation, save time, and reduce potential difficulties during the employment process.
3. Into Which Positions May Enterprises Recruit Foreign Employees?
Pursuant to Article 3 of Decree No. 219/2025/ND-CP:
“Article 3. Job Positions for Foreign Employees Working in Vietnam
1. A manager is an enterprise manager as defined in Clause 24, Article 4 of the Law on Enterprises, or the head or deputy head of an agency or organization as prescribed by law.
An executive director is a person falling under one of the following cases:
(a) The head of a branch, representative office, or business location of an enterprise;
(b) The person in charge of and directly managing a specific field within an agency, organization, or enterprise, who has at least three years of experience in a field relevant to the position that the foreign employee is expected to undertake in Vietnam.
2. An expert is a person falling under one of the following cases:
(a) Holding a university degree or higher, or an equivalent qualification, and possessing at least two years of experience relevant to the position that the foreign employee is expected to undertake in Vietnam;
(b) Holding a university degree or higher in the relevant field of study and possessing at least one year of experience relevant to the intended position in Vietnam, applicable to experts working in finance, science, technology, innovation, national digital transformation, or sectors prioritized for socio-economic development as determined by ministries, ministerial-level agencies, provincial People’s Committees, or under cooperation agreements with the Government of Vietnam.
3. A technical worker is a person falling under one of the following cases:
(a) Having completed at least one year of training and possessing at least two years of experience relevant to the intended position in Vietnam;
(b) Possessing at least three years of experience relevant to the intended position in Vietnam.”**
Accordingly, foreign employees working in Vietnam may be assigned to one of the following four categories of job positions:
(1) Manager
A manager is an enterprise manager as defined by the Law on Enterprises, or the head or deputy head of an agency or organization as prescribed by law.
Managers generally perform leadership and governance functions and are responsible for making strategic decisions concerning the operation and development of the enterprise or organization.
(2) Executive Director
- The head of a branch, representative office, or business location of an enterprise; or
- The person who heads and directly manages a particular field within an agency, organization, or enterprise and possesses at least three years of experience relevant to the position to be undertaken in Vietnam.
(3) Expert
A foreign employee is recognized as an expert if he or she satisfies one of the following conditions:
First Case
- Holds a university degree or higher, or an equivalent qualification; and
-
Has at least two years of work experience relevant to the position that he or she is expected to undertake in Vietnam.
Second Case
- Holds a university degree or higher in the relevant field of study; and
-
Has at least one year of relevant experience in the intended position in Vietnam, provided that the expert works in the fields of finance, science, technology, innovation, national digital transformation, or other sectors prioritized for socio-economic development as identified by competent authorities or under cooperation agreements with the Government of Vietnam.
The expert category is designed to attract highly qualified professionals whose knowledge and skills contribute to economic development, technological advancement, and the transfer of expertise within Vietnam.
(4) Technical Worker
A foreign employee is classified as a technical worker if he or she falls under one of the following cases:
First Case
- Has completed at least one year of vocational or technical training; and
- Has at least two years of work experience relevant to the intended position in Vietnam.
Second Case
- Has at least three years of work experience relevant to the intended position in Vietnam.
Technical workers generally perform specialized technical tasks requiring practical skills, technical expertise, or operational experience that may not necessarily require a university degree but still demand professional competency.
Conclusion
Foreign nationals wishing to work legally in Vietnam must simultaneously satisfy the requirements regarding age, legal civil capacity, professional qualifications, health status, criminal background, and work permit eligibility in accordance with the 2019 Labor Code. In addition, Vietnamese law recognizes various forms through which foreigners may participate in the labor market and permits them to work in four principal categories of positions: managers, executive directors, experts, and technical workers.
For employers, understanding these legal requirements is essential to ensuring compliance with labor regulations, facilitating lawful recruitment of foreign personnel, and avoiding legal liabilities.
