1. Người nước ngoài có được tự do làm việc tại Việt Nam không?
Việc người nước ngoài làm việc tại Việt Nam không chỉ phụ thuộc vào nhu cầu tuyển dụng của doanh nghiệp mà còn phải đáp ứng các điều kiện theo quy định tại khoản 1 Điều 151 Bộ luật Lao động, cụ thể:
Như vậy, để được làm việc hợp pháp, người lao động nước ngoài phải đáp ứng đồng thời các điều kiện về độ tuổi, năng lực hành vi dân sự, trình độ chuyên môn, sức khỏe, tình trạng pháp lý và giấy phép lao động.
2. Người lao động nước ngoài trong trường hợp nào không phải xin giấy phép lao động?
Giấy phép lao động là một trong những điều kiện quan trọng để người lao động nước ngoài được làm việc hợp pháp tại Việt Nam. Tuy nhiên, không phải mọi trường hợp người nước ngoài làm việc tại Việt Nam đều phải thực hiện thủ tục xin cấp giấy phép lao động.
Cụ thể, Điều 7 Nghị định 219/2025/NĐ-CP quy định:
Như vậy, người lao động nước ngoài không phải xin giấy phép lao động nếu thuộc một trong các trường hợp nêu trên.
Thứ nhất, pháp luật miễn giấy phép lao động đối với một số đối tượng có liên quan đến hoạt động đầu tư, quản lý doanh nghiệp tại Việt Nam
Thứ hai, một số trường hợp liên quan đến hoạt động hợp tác quốc tế, ngoại giao và thực hiện các chương trình, dự án
Bên cạnh đó, người nước ngoài là thân nhân thành viên cơ quan đại diện nước ngoài tại Việt Nam được phép làm việc theo điều ước quốc tế hoặc người mang hộ chiếu công vụ vào làm việc cho cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị – xã hội cũng thuộc trường hợp không phải xin giấy phép lao động.
Thứ ba, pháp luật còn quy định miễn giấy phép lao động đối với một số đối tượng trong lĩnh vực giáo dục và đào tạo.
Một nhóm đối tượng khác cũng được miễn giấy phép lao động là người nước ngoài tham gia các hoạt động mang tính hỗ trợ hoặc phi lợi nhuận. Ví dụ như tình nguyện viên
Ngoài ra, trường hợp di chuyển trong nội bộ doanh nghiệp cũng được miễn giấy phép lao động nếu đáp ứng các điều kiện luật định, bao gồm việc doanh nghiệp nước ngoài đã thành lập hiện diện thương mại tại Việt Nam và người lao động đã được doanh nghiệp tuyển dụng ít nhất 12 tháng liên tục trước khi được điều chuyển sang Việt Nam làm việc.
3. Kết hôn với người Việt Nam có được làm việc tại Việt Nam mà không cần giấy phép lao động?
Nhiều người cho rằng chỉ cần kết hôn với công dân Việt Nam thì người nước ngoài sẽ được miễn giấy phép lao động khi làm việc tại Việt Nam.
Tuy nhiên, căn cứ khoản 1 Điều 7 Nghị định 219/2025/NĐ-CP quy định: Người lao động nước ngoài không thuộc diện cấp giấy phép lao động nếu thuộc một trong các trường hợp quy định tại các khoản 3, 4, 5, 6, 7 và 8 Điều 154 Bộ luật Lao động.
Trong đó, khoản 8 Điều 154 Bộ luật Lao động 2019 quy định: “Người nước ngoài kết hôn với người Việt Nam và sinh sống trên lãnh thổ Việt Nam.”
Như vậy, để được miễn giấy phép lao động, người nước ngoài phải đáp ứng đồng thời hai điều kiện.
– Người đó phải có quan hệ hôn nhân hợp pháp với công dân Việt Nam.
– Người nước ngoài phải đang sinh sống trên lãnh thổ Việt Nam.

1. Are Foreigners Free to Work in Vietnam?
The employment of foreigners in Vietnam depends not only on the recruitment needs of employers but also on compliance with the conditions prescribed in Clause 1, Article 151 of the Labor Code, specifically:
“Article 151. Conditions for Foreign Employees Working in Vietnam
1. A foreign employee working in Vietnam is a person holding foreign nationality and must satisfy the following conditions:
a) Be at least 18 years of age and possess full civil act capacity;
b) Have professional qualifications, technical expertise, skills, and work experience; and possess sufficient health as prescribed by the Minister of Health;
c) Not be serving a criminal sentence, have an unspent criminal record, or be subject to criminal prosecution under foreign law or Vietnamese law;
d) Hold a work permit issued by a competent Vietnamese authority, except in the cases specified in Article 154 of this Code.”
Accordingly, to work legally in Vietnam, foreign employees must simultaneously satisfy the requirements regarding age, civil act capacity, professional qualifications, health status, legal status, and possession of a valid work permit.
2. In Which Cases Are Foreign Employees Exempt from Obtaining a Work Permit?
A work permit is one of the key requirements for foreign employees to work legally in Vietnam. However, not all foreigners working in Vietnam are required to complete work permit procedures.
Specifically, Article 7 of Decree No. 219/2025/ND-CP provides:
“Article 7. Foreign Employees Exempt from Work Permit Requirements
1. Foreign employees falling under the cases specified in Clauses 3, 4, 5, 6, 7, and 8 of Article 154 of the Labor Code.
2. Owners or capital-contributing members of a limited liability company whose contributed capital value is at least VND 3 billion.
3. Chairpersons of the Board of Directors or members of the Board of Directors of a joint-stock company whose contributed capital value is at least VND 3 billion.
4. Individuals entering Vietnam to provide professional and technical consulting services or perform other tasks serving the research, formulation, appraisal, monitoring, evaluation, management, and implementation of programs and projects using official development assistance (ODA) in accordance with regulations or agreements contained in international treaties on ODA signed between competent Vietnamese and foreign authorities.
5. Foreign journalists engaged in press and media activities who have been certified by the Ministry of Foreign Affairs.
7. Foreign pupils, students, and trainees studying at schools or training institutions in Vietnam or abroad who have internship agreements or employment invitation letters from employers in Vietnam; and trainees or interns serving on Vietnamese seagoing vessels.
9. Holders of official passports working for state agencies, political organizations, or socio-political organizations.
10. Individuals responsible for establishing a commercial presence.
12. Individuals entering Vietnam to implement international agreements signed by central-level agencies, provincial-level authorities, or organizations in accordance with the law.
13. Foreign employees who are managers, executive directors, experts, or technical workers in one of the following cases:
a) Entering Vietnam to work for a total period of less than 90 days in one calendar year, calculated from January 1 to the last day of that year;
b) Intra-corporate transferees: individuals temporarily transferred within a foreign enterprise that has established a commercial presence in Vietnam and operates within the scope of the 11 service sectors committed by Vietnam to the World Trade Organization, provided that they have been employed by the foreign enterprise for at least 12 consecutive months prior to the transfer. Commercial presence includes foreign-invested economic organizations; representative offices and branches of foreign traders in Vietnam; and operating offices of foreign investors under business cooperation contracts.
14. Individuals certified by the Ministry of Education and Training to enter Vietnam for the following purposes:
a) Teaching, research, or transfer of international education programs;
b) Serving as managers, executive directors, principals, or vice principals of educational institutions established at the request of foreign diplomatic missions or intergovernmental organizations in Vietnam.
15. Individuals certified by ministries, ministerial-level agencies, or provincial People’s Committees to work in Vietnam in the fields of finance, science, technology, innovation, national digital transformation, and other sectors prioritized for socio-economic development.”
Accordingly, foreign employees are exempt from obtaining a work permit if they fall within one of the categories listed above.
First, the law grants work permit exemptions to certain individuals involved in investment activities and business management in Vietnam.
Second, exemptions apply to certain cases related to international cooperation, diplomatic activities, and the implementation of programs and projects.
In addition, foreigners who are family members of members of foreign representative offices in Vietnam and are permitted to work under international treaties, as well as holders of official passports working for state agencies, political organizations, or socio-political organizations, are also exempt from the work permit requirement.
Third, the law provides work permit exemptions for certain individuals working in the field of education and training.
Another group of exempt individuals includes foreigners participating in support-oriented or non-profit activities, such as volunteers.
Furthermore, intra-corporate transferees are exempt from obtaining a work permit if they satisfy the statutory conditions, including the requirement that the foreign enterprise has established a commercial presence in Vietnam and that the employee has been employed by the enterprise for at least 12 consecutive months before being transferred to Vietnam for work.
3. Can a Foreigner Married to a Vietnamese Citizen Work in Vietnam Without a Work Permit?
Many people assume that once a foreigner marries a Vietnamese citizen, they are automatically exempt from obtaining a work permit when working in Vietnam.
However, pursuant to Clause 1, Article 7 of Decree No. 219/2025/ND-CP, foreign employees are exempt from work permit requirements only if they fall within one of the cases specified in Clauses 3, 4, 5, 6, 7, and 8 of Article 154 of the Labor Code.
Among these cases, Clause 8, Article 154 of the 2019 Labor Code provides:
“A foreigner who is married to a Vietnamese citizen and resides within the territory of Vietnam.”
Accordingly, a foreigner may be exempt from obtaining a work permit only when both of the following conditions are satisfied simultaneously:
+ The foreigner must have a legally recognized marriage relationship with a Vietnamese citizen; and
+ The foreigner must be residing within the territory of Vietnam.
Therefore, marriage to a Vietnamese citizen alone does not automatically exempt a foreigner from the work permit requirement. To qualify for the exemption, the foreigner must not only be legally married to a Vietnamese citizen but must also be residing in Vietnam. Once these two conditions are met, the foreigner may work in Vietnam without being required to obtain a work permit in accordance with the provisions of Vietnamese labor law.
